Artificial Intelligence and Machine Learning – Usage Rights and Protection Strategies

Join us at the Marriott City Center Hotel in downtown Minneapolis on Wednesday, April 19, 2023, for this timely discussion! Artificial intelligence tools, including generative AI systems such as ChatGPT and DALL-E, are at a stage of rapid evolution and improvement. We will review a few of these tools, as well as discuss IP (patent and copyright) ownership and data privacy issues associated with usage. We will then take a look at the patent landscape for artificial intelligence and machine learning systems and discuss with local IP counsel strategies for identification and protection of software-driven processes, including machine learning and artificial intelligence-assisted business processes.

Crisis Management Beyond Emergency Response

Because the best crisis is one that never occurs, and because government agencies often expect robust pre-planning, it is crucial to develop policies, procedures, and training aimed at incident prevention and mitigation beyond and apart a company’s typical emergency response plan. This panel will discuss best practices for crisis management, internal investigations, incident response for corporate crises across industries.

In the increasing war for talent, businesses have to be more proactive than ever in protecting their business interests, whether that is their confidential information, trade secrets or the stability of their workforce. One way businesses have used to protect their interests is through the use of restrictive covenants and non-compete clauses in employment contracts.
 
Given that states in the US and countries across Europe have enjoyed the individual freedom to regulate this area, we have been working with a patchwork of different approaches to restrictive covenants and non-compete clauses, but there are some common themes. There are also fundamental changes proposed in the US and Europe with legislators seeking to abolish or restrict the use of non-compete clauses, which could significantly reduce the protection available for employers going forward.
 
In this seminar we will explore:
 
1.    The FTC’s Notice of Proposed Rulemaking (NPRM)
2.    State trends
3.    Other global trends
4.    Potential pitfalls for businesses

Many sectors are making broad and bold commitments to achieve diversity, equity, and inclusion, including implicit bias awareness training, efforts to expand inclusion in the workplace, and setting numerical targets as a means to measure progress. These commitments have been part of the growing Environmental, Social, and Governance push in corporate America. At the same time, “wokeness” allegations have surfaced and affirmative action cases are before the Supreme Court.
 
Chris Wilkinson from Perkins Coie's office in Washington, DC and Abdul Kallon with the firm's office in Seattle will provide an overview of the current DEI legal landscape, strategies and tools used to foster diversity and inclusion, and the headwinds facing this work.
