Earlier this month, US Department of Justice (DOJ) Antitrust Division Deputy Assistant Attorney General Richard Powers announced that the DOJ intends to investigate and pursue alleged criminal activity against individuals or companies who violate Section 2 of the Sherman Act, marking a significant departure from the agency’s longtime enforcement strategy of avoiding criminal prosecution and instead bringing a civil case.

Join McDermott Antitrust Partner Kate O’Connor for a roundtable lunch discussion that will dive into the details of Powers' announcement and discuss what to expect next as we continue to monitor DOJ enforcement of Section 2 claims amidst a radically changing antitrust environment.

Discussion topics will include:
•    Background on Powers’ announcement, including a brief history of criminal enforcement in Section 2 cases
•    Thoughts on next steps from the DOJ and the potential for further guidance
•    Strategies companies can implement now to prepare for heightened scrutiny
