Emerging cyber laws and regulations coupled with increasing cyber threats requires leadership to proactively manage and address risks facing their organizations. Often times the responsibility to develop a compliance and cyber program is entrusted to in-house counsel. With sophisticated threats targeting supply chain coupled with a prescriptive regulatory landscape, failure to understand the consequences of cyber risk places an organization, its employees, customers, and stakeholders at risk. Hear actionable guidance from inside and outside counsel about how to build a cyber program that inspires trust through emotional intelligence and leveraging relationships within the enterprise.

Using examples of apocalyptic visions in cinema as analogy and backdrop, this 2-hour ethics CLE will discuss changes, or the lack of changes, in selected professional rules and the driving policy considerations underlying what might be characterized as ethics evolution by some and stagnation, devolution, or “apocalypse” for the profession by others as related to the following topics:

  • The (d)evolution from the doctrine of champerty to the acceptance for contingency fee work and litigation funding.
  • The (d)evolution from the need to strictly safeguard a lawyer’s professional independence from non-lawyer ownership and management to (some) tolerance for non-lawyer involvement in management or potentially law firm ownership.
  • The (d)evolution from bans on lawyer advertising to rules that broaden the ways in which lawyers may share information about legal services.
  • A shift from encouraging “zealous” representations and prioritizing client confidentiality and loyalty toward rules and laws emphasizing civility and conscripting lawyers to amplified gatekeeping duties.
  • The (d)evolution from full-service lawyers and law firms to unbundled legal services and artificial intelligence.
  • The rise of client-generated engagement letters and outside counsel guidelines.
  • State-by-state licensing and regulation of lawyers.

Join us for a 2-hour Patent intensive presentation.  Patent law has become increasingly important as technological innovation growth has accelerated. Most companies will face patent law issues at some point, whether in developing a patent portfolio, facing accusations of patent infringement, or licensing technology. The challenge for non-patent attorneys is facing a combination of technology and a field of law that can both be dauntingly complex.

The first hour of the program will offer in-house counsel an overview of patent basics for newcomers to the field.    The second hour will offer a deeper dive into recent developments in patent law and key issues for those in-house counsel already having some exposure to patent law, in particular in technologies including life sciences/biotech and IT.

Please join us for just one or both hours of this event.

Agenda:
12:00 pm – 1:00 pm – Patent Overview
1:00 pm – 2:00 pm – Patent Law Recent Developments/Key Issues

Presented by Rouget Frederic Henschel, Partner and Amanda Baker, Counsel at Potomac Law Group and David Beck, Chief IP Counsel and Vice President at VIAVI Solutions LLC.

On Thursday, November 10, 2022, join Norton Rose Fulbright lawyers and the Association of Corporate Counsel (ACC) Minnesota as our panel of speakers presents “Life After Breach”. Data breach headlines have dominated the news cycle in the last 24 months. Nowadays, regulators are taking a hard look at the breach and seizing the opportunity to do a full-scale review of a company’s cyber, privacy and data practices. As a result, organizations need to be prepared to bring the receipts and explain why and how data was being collected, processed and retained. Regulators will look for an explanation of data collection and deletion practices, Privacy by Design, deidentification, and other privacy and security-friendly choices that could have mitigated the fallout from a breach.

In addition to discussing this relevant topic and earning CLE credit, we are returning to The Minikahda Club and its fine food and beverages!

Agenda:

  • Check-in and refreshments: 4:00 PM - 4:30 PM CT

Every company is a tech company and any company that isn’t a tech company is losing. One of the most important aspects of any emerging technology and innovation effort is the existence, maintenance, protection, and use of data, but most companies have only begun to scratch the surface of their legal and regulatory obligations with regard to the data that flows in, through, and out of their systems every day – regardless of industry focus. At Frost Brown Todd LLC, we have significant experience working with companies of all shapes and sizes and across industries and advising them with regard to ensuring compliance in the collection, use, and securitization of data in all aspects to make their efforts more efficient, effective, and profitable. We will look forward to exploring the most up to date developments in the data privacy area as well as outlining next steps in the constantly growing and evolving global landscape of data. Registration : 4:45 p.m. to 5:00 p.m. Program: 5:00 p.m. to 6:00 p.m. Reception: 6:00 p.m. to 7:00 p.m. This program has been preapproved for one hour of PA substantive CLE credit.

For corporate boards, providing management oversight and strategic direction is expanding to include Environmental, Social and Governance (ESG) considerations. Board members must be able to assess both the business and legal risks across a range of ESG functions; from disclosures to supply-chain due diligence to reducing greenhouse gas emissions

Boards also are increasingly expected to address challenging hot issues involving human rights and Diversity Equity & Inclusion (DEI), such as LGBTQ+ rights, racial and gender equality, reproductive rights, and human trafficking.  Join us for a discussion of the Board’s role in navigating ESG strategies and differing approaches, whether a company is small or large, public or private.

Presented by Teresa Johnson, Partner, Corporate & Finance and Peter Gioello, Counsel, Environmental at Arnold & Porter and Shanda Botts, SVP, Ethics and Compliance, Employment Law & Litigation at AARP.
