Please join Akin and the Association of Corporate Counsel Southern California for an informative program on choice of law and forum selection considerations in commercial contract drafting. We will focus on the state contract laws and interpretation principles of five key states: California, Delaware, Florida, New York and Texas. The presentation will analyze each state’s substantive contract law and interpretation principles, with a focus on the types of provisions and breaches that companies are most likely to encounter. The choice of law and forum selection considerations discussed as part of the presentation may be used:

  • To determine whether any of the key states’ laws should or should not be      chosen in a contractual choice of law provision.
  • To evaluate potential forums for litigating disputes—specifically, arbitration vs. courts in the key states.
  • As an initial reference to aid in determining business and litigation strategies should a contractual dispute arise or be anticipated.

 

A cocktail and networking reception will follow on the outdoor patio of Espelette, Waldorf Astoria’s signature restaurant, serving coastal Mediterranean fare.

AZA Presents: What Today's Lawyers Are Doing Wrong and How to Stop Them 

When it comes to trial, today's litigators often think like litigators. This is a problem. Juries do not think like litigators. In this CLE, Todd Mensing, Rey Flores and Jason McManis of AZA will present how in-house counsel can identify when their litigators are not preparing their case for the realities of a jury trial, and how to chart a course correction before it is too late. This includes how to pursue effective theme and story-building in discovery and trial, the correct use of visuals at trial, and powerful strategies for motivating juries.

The panel will explore the impact of the "Forward Through Ferguson" report, which made specific recommendations for regional reform.  The panelists, who are all members of the Ferguson Report, will discuss which recommendations were adopted, which were not, and the reasons behind these outcomes.
