The COVID-19 pandemic is significantly impacting the litigation space.  Experienced trial attorneys, Bron D’Angelo and Andrew Smith, who practice in the areas of Business Litigation and Personal Injury-Defense, will lead a discussion on how the California state and federal courts are handling litigation and trials during the COVID-19 pandemic.  They will share their insights and provide an overview of the fast-developing changes in the litigation landscape; addressing evolving court practices along with critically important issues such as handling depositions, hearings, and mediations remotely.  They will also discuss the nature and extent of delays in trials, as well as virtual jury trials and how COVID-19 may affect how jurors decide cases.

Join our Litigation Law Committee for a morning of relevant CLE!

Agenda:
  • Session I – 9:00 a.m. to 10:00 a.m. Litigating Complex Legal Issues Under the Scrutiny of Public Opinion presented by Manko, Gold, Katcher & Fox LLP

More and more, Pennsylvania has been the scene of highly visible and controversial projects that have been challenged by opponents before agencies, administrative appeals boards and state and federal courts. With the advent of social media, and real time transmission of testimony through that social media, litigating these issues is more visible and raises many issues, including how to message to both the judge and the wider public audience at the same time, how to limit public interference in those proceedings, how to use social media statements in cross examination of opposing witnesses and how to avoid testimony in one matter being used adversely in other matters, civil and criminal. Using real world examples, this session addresses these and other issues.

Break – 10:00 a.m. to 10:30 a.m.

  • Session II – 10:30 a.m. to 11:30 a.m. Be an Expert at Experts: Expert Mistakes and How Best to Avoid Them presented by Obermayer Rebmann Maxwell & Hippel

Expert witnesses serve a critical role in litigation, particularly in complex cases.  Experts are especially critical in cases where lay witnesses are unable to proffer the evidence necessary for the party to secure a favorable verdict.  Notwithstanding an expert’s import, many attorneys make simple mistakes in choosing and presenting the expert, including some which lead to the expert’s disqualification.  Disqualification can be fatal to a case, as, at least in federal court, only expert witnesses are permitted to opine as to the case’s ultimate issue.

Break – 11:30 a.m. to 12:30 p.m.

  • Session III – 12:00 p.m. to 1:00 p.m. presented by Ogletree, Deakins, Nash, Smoak & Stewart, P.C.

COVID-19 Litigation Trends and Steps to Mitigate Liability

Our expert panelists will discuss the types of litigation that employers can expect as a result of the COVID-19 pandemic.  Current and projected litigation trends, liability shield and workers’ compensation legislation, defenses and mitigation strategies, and practical considerations for the defense of COVID-19 cases will be covered.

Virtual mediations and arbitrations have become the reality for many in-house professionals these days.  No more the temporary fix to resolving business disputes, while we work remotely, the efficiency & effectiveness of virtual ADR (Alternative Dispute Resolution) is here to stay!   What are the lessons learned from virtual dispute resolution during Covid and how can in-house lawyers leverage these learning to drive future successful dispute resolutions?

ACC Northeast and JAMS invites you to this webinar to hear from practitioners on the pros and cons of virtual ADR and what they have learned in 2020.  Our panel will offer insights on preparation, strategy, settlement examples and best practices on key practical considerations to ensure a successful process.

For those new to virtual ADR, this webinar will help demystify the process and familiarize you with settlement procedures.  For those more experienced, our panel will discuss trends  (resolution rate is much higher) and the lessons learned from this form of virtual communication.

Register below.  All registrants will receive the ZOOM webinar address 24 hours prior to the event.

Cyber-attacks are at an all-time high, as cyber criminals take advantage of disrupted work forces across the globe due to Covid-19. It is not a question of if, it is a question of when.  We will address how to plan for and handle the day your company and its data become a cyber target.  We will provide best practices before, during and after a data breach investigation to reduce the risk of liability from claims brought by regulators as well as the plaintiffs’ bar.  The session will include illustrative case studies involving attacks by nation states and other internal and external threat actors and their methods, including ransom, phishing, and various malware.  We will focus on areas of risk (including the increased risk of insider sabotage since Covid), and how best to protect privilege and defend against actions brought by FTC, HHS/OCR, the SEC Cyber division and other regulators in the wake of data breaches.  We also will discuss how to prepare for and defends against the inevitable class action litigation brought by the plaintiffs’ bar.
