This program will focus on alternative dispute resolution in its current state of practice, what’s working and what’s not working. Arbitration clauses and arbitration forums will be exemplified and discussed, with emphasis given to well-drafted and not-so-well drafted clauses, arbitrator neutrality, selection and misconduct, discovery in arbitration and enforcement of awards. The presentation will also include a discussion of international arbitration principles and practice. The second phase of this presentation will explore mediation and med-arb alternatives with discussion about mediator selection, the role of in-house lawyers and outside counsel in mediation and the role of settlement counsel.

Pennsylvania courts, particularly Pennsylvania federal courts, have recognized an unusual jurisdictional hook called “conspiracy jurisdiction.”  This theory is relevant to corporate structures for which parent companies could be swept into Pennsylvania actions based on alleged conspiracy with subsidiaries.  On closer examination, this jurisdictional theory may be an aberration, overextending dicta in old state opinions without a ruling from the Pennsylvania Supreme Court.  Questions also arise whether conspiracy jurisdiction comports with due process.  This presentation will explore the genesis and potential limitations of the theory in order to prepare for and better defend against its use.

Join us for an informational discussion on pending Texas House Bill 1875 on the creation of Business Courts in Texas. For the first time, all of Texas ACC members are invited to attend a webinar CLE together.  Special thanks to The Texas Lawbook. 

With the goals of improving efficiency, predictability, and avoidance of pandemic-related delay in complex commercial litigations and fostering business in Texas, HB 1875  proposes that Texas join Delaware and 28 other states and create specialized business courts to handle sophisticated business litigations. Key panelists will be discussing the pros and cons of HB 1875 with moderator Mark Curriden of The Texas Lawbook.
