Pennsylvania courts, particularly Pennsylvania federal courts, have recognized an unusual jurisdictional hook called “conspiracy jurisdiction.”  This theory is relevant to corporate structures for which parent companies could be swept into Pennsylvania actions based on alleged conspiracy with subsidiaries.  On closer examination, this jurisdictional theory may be an aberration, overextending dicta in old state opinions without a ruling from the Pennsylvania Supreme Court.  Questions also arise whether conspiracy jurisdiction comports with due process.  This presentation will explore the genesis and potential limitations of the theory in order to prepare for and better defend against its use.
