The Committee on Foreign Investment in the United States (CFIUS) recently released its Annual Report for the calendar year of 2022.  In addition to the trend that CFIUS required mitigation measures in nearly one out of every four unique transactions for which a notice was filed, Singapore has emerged as the new lead investor country in notices.

This program will feature an interactive discussion of national security concerns facing companies today. With today’s ever-changing geopolitical climate, governments and regulators have given increased scrutiny to foreign investments that involve emerging and critical technologies, critical infrastructure, and personal data. Understanding the shared regulatory trends, as well as unique considerations of each regime, has become critical for those engaged in international trade, investment, and mergers and acquisitions. The speakers will discuss:

  • Key takeaways from CFIUS Annual Report
  • Continued focus on personal data, particularly security around foreign nations and threat actors
  • Case studies of recent transactions
  • “Reverse CFIUS” proposal on potential regulation for outbound investment out of the US and into international companies and resources

 

This program will offer two perspectives on managing the corporate litigation process.

The first half will be presented by firm-side attorneys who manage litigation. The speakers will cover what in-house counsel needs to know about preventing and responding to litigation, and how to best work with their outside firm throughout the process.

During the second portion of the program, The Hon. J. Philip Calabrese will share a behind-the-bench perspective on how in-house counsel can best prepare themselves and their outside counsel for litigation.
