ACC Houston IP Practice Group CLE: IP Terms for Non-IP Agreements

This presentation will focus on IP issues typically encountered in structuring and negotiating non-IP agreements (such as consulting, supply/purchase agreements, and professional services agreements), and offer practical drafting suggestions for addressing those issues.

Last March, the Deputy Attorney General of the U.S. Department of Justice, Lisa Monaco, explained: “Corporate crime, as we all know, jeopardizes jobs, savings, our economic security, and increasingly, our national security, Because in today's complex and uncertainty geopolitical environment, corporate crime and national security are overlapping to a degree never seen before, and the department is retooling to meet that challenge. Our National Security Division will be elevating its attention to corporate crime through an infusion of personnel and expertise. Included in the category of corporate crime are intellectual property crimes, like trade secret theft, which often crosses national borders. In this session, we will focus on current U.S. enforcement trends involving international IP crimes, and how companies can succeed when working with the government to prove they have been victimized and deserve the special role the judicial system assigns to victims.

This article discusses some of the key issues nonprofit organizations encounter with copyrights.

Globally the fashion and furniture industries are expected to generate over $770 billion and $765 billion, respectively, in 2024. These two giant industries overlap in many ways, including design, innovation, copying, and functionality. And the overlaps prevalent in both industries implicate the same intellectual property laws, namely, design patent, copyright, and trademark or trade dress. The panelists will discuss recent intellectual property trends relating to fashion and furniture designs. The panelists are experts in their respective fields: Scott Shaw, an intellectual property litigator with emphasis in the fashion and furniture industries; Maryn Miller, an in-house fashion law attorney; Shannon King, an in-house furniture and home goods attorney; and, Chris Buccafusco, a Duke intellectual property law professor. The panel moderator is Joni Gaudes, EVP, General Counsel, Hybrid Apparel.

This program includes a review of federal and state trade secret statutes, updates on the FTC‘s recently issued rule respecting noncompetes, and best practices to protect confidential business information going forward.
