GC/CLO Lunch & Law - Privilege

The CLO luncheons are intended for in-house counsel who oversee the legal department whether as GC, CLO or an alternative title.

Join your fellow Alberta in-house law department leaders for an open discussion on Privilege. The discussion will be led by Sarah King, Associate GC, Canadian Western Bank, and Michael Briggs, Partner and Litigator with McMillan.

The concept of legal privilege and knowing when and how to apply it are matters that continue to challenge legal teams and department leaders. We will discuss the subtle nuances of legal privilege, the ways in which it is evolving, and the need for clear protocols and processes to ensure privilege is commonly understood and applied across organizations and within legal teams. Topics will include:

  • Types of privilege, when and which are triggered.
  • Litigation holds, preservation of privilege, and processes.
  • Preserving privilege of all records, including challenges presented by new technologies.
  • When does counsel need to be involved and have a seat at the table.
  • Considerations around investigations and retaining outside experts and counsel.
  • Lessons learned and cautionary tales.

Speakers

Sarah King, Associate GC, Canadian Western Bank. Sarah began practising law in 2007 at Parlee McLaws LLP, a 100+ year old Alberta-based law firm. From there, she joined Dentons as a litigation associate before moving in‑house to ENMAX in 2014. Earlier this year, Sarah joined Canadian Western Bank as Associate General Counsel – Risk & Enterprise and Chief Ethics Officer. At CWB, Sarah’s practice areas focus on litigation and dispute resolution, employment/hr matters, privacy, regulatory compliance, investigations, and ethics. In her spare time, when she’s not hanging with her family, Sarah sits on the board of ACC Alberta, volunteers with the Laskin Moot, and plays the trumpet in a local 17-piece big band.

Michael D. Briggs FCIArb, Partner, Litigation & Dispute Resolution, McMIllan LLP. Michael is a seasoned litigator with a wealth of experience managing all aspects of disputes, from initial strategy through pleading, records disclosure, discovery questioning, interlocutory applications, trials and appeals. His practice is focused on complex corporate/commercial litigation, including construction and oil and gas litigation, in addition to a wide variety of contractual and shareholder disputes, oppression and derivative actions, as well as fiduciary, fraud and breach of confidence cases.
