ACC Alberta- Remote Work/Work-from-Home Arrangements: Covid-19 has set the precedent for remote work/work-from-home arrangements, and it’s anticipated that even beyond the pandemic, these arrangements will remain a more common feature of Canadian workplaces. Our panel will review key employment law implications and challenges arising out of remote work/work-from-home arrangements, including practical tips for drafting and implementing work-from-home policies, employment contract considerations, and approaching interprovincial and international jurisdictional issues that may arise.
- Workplace Vaccine and Testing Policies: As Covid-19 vaccines and testing become more readily accessible, many employers are considering implementing vaccine or testing policies as a means to control outbreaks in the workplace. The panel will discuss the legal risks associated with such policies, and review key considerations required prior to and during implementation of such policies.
- Case Law Update: The panel will highlight noteworthy cases from 2020 and their potential implications for employers in 2021.
- Enforceability of contractual provisions limiting incentive compensation on termination of employment: Matthews v. Ocean Nutrition, 2020 SCC 26
- Unlawful just cause termination provision invalidates lawful without cause termination provision: Waksdale v. Swegon North America Inc. 2020 ONCA 391 (leave to appeal refused)
- Expansion of duty of honest performance in contract: C.M. Callow Inc. v. Zollinger, 2020 SCC 45
Speakers
Angela Jackson is the Employment Counsel & Senior Director, Contracts & Immigration, with the University of Calgary. She is a frequent speaker on Privacy, Employment Law and Human Rights Issues. Angela serves as a Director with the ACC Alberta Board of Directors.
Jed Blackburn is a partner in the Employment & Labour and Universities & Colleges Groups at Cassels Brock & Blackwell LLP. Jed focuses on resolving disputes for clients on favourable terms and has done so for wide variety of clients ranging from educational institutions to multinational corporations.
