ACC New York CityDemand letters on employment law matters come in all shapes and sizes. Some present honest efforts to resolve potential claims; others are hyperbolic “nastygrams” intended to strong-arm a settlement. In this program, our speakers Laurent Drogin and David Kleinmann, who will be joined by an in-house counsel panelist, will use highlights from actual “demand letters” to discuss how they should be reviewed and assessed from a liability and damages perspective, and considerations on how, if at all, to respond. Among other topics, the program will cover decoding the issues, using the letter to either thwart or in anticipation of subsequent litigation, when and when not to label responsive communication “For Settlement Purposes Only” and common mistakes made when dealing with a demand letter.
