This year has posed unprecedented challenges for California employers. We know that in addition to keeping your employees safe and maintaining business continuity, it is difficult to keep track of the rapidly changing employment law landscape in California. We are here to help!

This webinar, co-hosted by the ACC San Francisco Bay Area and Southern California chapters, is designed to ensure that in-house counsel are up to speed on what changed in 2020 and prepared for what's on the horizon in 2021 for California employers.

In this 75-minute virtual session, we will review the top ten developments that impacted California employers in 2020 and predictions for 2021. We will provide practical tips for navigating the new normal and checklists to keep you on track. Among other topics, you will hear about:

  • New COVID-specific laws applicable to California employers
  • Important new obligations during layoffs

The new Board diversity requirement, and lessons from the

Restructuring may be the “word of the year” for 2020 and while there may be abundant opportunities, it may also feel like you are navigating a minefield of potential threats. Our panel will provide the perspective of a deal lawyer, litigator, and restructuring specialist to discuss how in-house counsel can capitalize on opportunities, while avoiding pitfalls. They will discuss:

 ·         Overview of the bankruptcy framework

·         Effect of the automatic stay

·         Selling assets in a bankruptcy case

·         Alternatives to selling distressed assets

·         Executory Contracts

·         Filing a claim

·         Avoiding preference / fraudulent transfer liability

·         Should my client serve on a creditor’s committee

Please join Winston & Strawn’s International Trade team for a timely discussion on how international trade policies and agendas are expected to change under a Biden administration, and what this means for your company. In particular, we will discuss economic sanctions and export and import agendas, hone in on the expectations with respect to China, and provide guidance as to how your company might start to implement, review, or revise compliance measures in order to prepare for such changes.

While 2020 and the global pandemic continue to bring unique challenges to the workforce, other equally important social issues have since (re)surfaced and require an equally thoughtful strategy and response. Please join Seyfarth Shaw and ACC SoCal for a panel discussion on managing the workforce in the midst of the current social and political climate. Topics will include:

  • First Amendment protections in the workplace
  • Political and social justice speech in the workplace in turbulent times
  • Rationales for limiting workplace speech
  • NLRA issues
  • California political speech issues
  • Considerations in managing employee communications to maximize productivity and morale

As the COVID-19 pandemic has accelerated the digital revolution, attention in Washington, D.C. and elsewhere has turned to antitrust in technology.  This panel, featuring in-house counsel from Facebook, Twitter, Lyft, and Square, will address a variety of practical topics regarding the work of in-house competition counsel, including the relative roles of inside and outside competition counsel, educating enforcers on the business of technology, and the transition from enforcer to in-house counsel.  In addition, the panel will address recent high-profile cases and guidance from the Department of Justice.

Social Justice – Report Card: Evolution of Diversity, Inclusion & Equity in the Legal Profession

Fair Credit Reporting Act (FCRA) litigation has continued to increase as both consumers and employees challenge the adequacy of companies’ credit investigation and reporting practices. Amendments to the FCRA as part of the CARES Act have changed the obligations of furnishers of information. Employee claims under the FCRA have continued to increase, as courts grapple with the FCRA’s requirements regarding employee background checks. Over the course of this year, the Ninth Circuit has issued three seminal decisions (Walker v. Fred Meyer, Luna v. Hansen and Adkins, and Marino v. Ocwen Loan Servicing) that have provided helpful guidelines.

This webinar will provide an overview of recent developments, and identify current best practices of reducing risks of potential class action litigation under the FCRA and state statutory restrictions on credit reporting. Our speakers will identify current litigation trends, recent regulatory developments, and issues on the horizon as employers and furnishers of credit information grapple with the ever-changing requirements.

Speakers:

Hyongsoon Kim, Partner, Irvine Office, Akin Gump

Connect with other in-house counsel virtually in our new Check-In & Well-being Breaks. ACC-SoCal is offering regular come-as-you-are, informal opportunities to chat with fellow ACC-SoCal in-house counsel. Our Breaks are not limited to work/professional life; we will talk about some of our recent challenges (thorns), accomplishments (roses), and wellness issues and practices, whether to vent a little, seek or give feedback, support, and guidance, or just share or listen.  Active participation is voluntary. These informal sessions will be hosted by members of the ACC Southern California Attorney Well-Being Committee.  This Check-In will focus on holiday anxiety in these uncertain times.
