Making Teams More Productive Through Neurodiversity
(1.0 Hour Implicit Bias Credit)

Neurodiverse individuals make up a significant portion of the workforce, including the legal workforce.  Due to actual and perceived biases in companies and law firms, these talented individuals often try to mask their true selves, which is exhausting, inauthentic, and can be permanently damaging. This presentation will explore how to recognize different forms of neurodiversity and how to ally to create an inclusive environment beneficial for everyone.  The panel will provide easy and practical strategies that legal teams can adopt to accommodate neurodiverse individuals and allow them to thrive.

Speech, Safety, and the Law: When Politics Enter the Workplace
(1.0 Hour Elimination of Bias Credit)

Political conversations are common in the workplace. While employees value their free expression, several practical steps can serve a dual purpose of supporting employee well-being while minimizing risks. These risks include potential claims of discrimination, harassment, retaliation, and violations of the California Labor Code. Given these potential liabilities, it’s essential for employers to proactively communicate acceptable standards for workplace political speech. This program will cover employer lessons for how to identify and mitigate legal risks related to workplace political speech, including:

  • Potential pitfalls created by workplace political speech
  • Development of workplace policies to mitigate risks without violating applicable laws
  • Effective investigation of workplace complaints involving political speech
  • Summary of recent litigation involving workplace political speech
  • Preview of anticipated legislation regarding political conduct in the workplace

NOON - 1:00PM | BEVERIDGE & DIAMOND
Ethical Pitfalls and Best Practices in Superfund and Other Multi-Party Litigation
(1.0 Hour Ethics Credit)

This webinar will give in-house counsel a practical overview of key ethics issues that commonly arise in Superfund matters—conflicts, waivers, joint versus separate counsel, and common-interest arrangements—and how the same challenges often appear in non-environmental multi-party disputes. The speakers will discuss strategies for identifying misaligned interests, protecting privilege, and managing communications among multiple represented parties. Although viewed through the CERCLA lens, the principles covered will equip counsel to navigate ethical obligations in a wide range of complex, multi-party litigation contexts.

Lauren Murvihill, Associate, Beveridge & Diamond.

1:15PM - 2:15PM |  LAWYERS CONCERNED FOR LAWYERS PENNSYLVANIA
Professionals At Risk – Detection, Prevention and The Conspiracy of Silence
(1.0 Hour Compentence: Prevention & Detection Credit)

  • I’m ok. I can work this out for myself.
  • I’m not like a “real” alcoholic anyway.
  • I want help but I don’t want anyone to know.
  • Will I be reported to Discipline?

Sound familiar?  Recent studies have shown that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession. The statistics are compelling and clearly indicate that 1 out of 3 attorneys will likely have a need for substance use or mental health services at some point in their careers.  There is a misconception among lawyers that only people who have “hit bottom” need or ask for help. The statistics say otherwise as recent surveys indicate that the overwhelming majority of legal practitioners believe they have suffered negative mental health consequences as a result of their chosen profession.

Add to that the “we have to stick together and keep this quiet ” attitude of many members of the profession, and we have a perfect storm for creating distressed, impaired lawyers. Mr. Quinn will discuss:

  1. The early warning signs of distress and impairment due to substance misuse and mental health issues.
  2. Strategies that we can use every day to alleviate the stressors that lead to addiction, burn out and compassion fatigue.
  3. The confidential services that Lawyers Assistance Programs provide to lawyers, judges, their family members and law students.
  4. What barriers exist that prevent lawyers from seeking the help they need and how enabling our colleagues can put them at even greater risk.

Brian S. Quinn, Esq., Education and Outreach Coordinator, Lawyers Concerned for Lawyers of Pennsylvania

In-House 101: Pathways to Finding an In-House Role, Being Effective In-House, & Best Practices as Outside Counsel for In-House Legal Departments

Whether you are interested in going in-house, new to being in-house, or are working with in-house counsel, please join us for a one hour panel discussion with ACC members about their career paths that lead them to in house roles, tips and tricks for transitioning from private practice to your first in house role, and best practices for outside counsel serving in house legal departments for litigation and more.  Meet in-house counsel for a one-hour social hour after the panel discussion.

Inside Counsel, Outside the Lines: Navigating California’s Ethics Rules for In-House Lawyers

In-house counsel face a unique set of ethical challenges that traditional law firm attorneys rarely encounter. In this fast-paced, practical session, Jen Shaw, one of California’s leading employment-law and ethics educators, breaks down the complex obligations that arise when your “client” is an organization rather than an individual.

Through real-world examples and interactive discussion, attendees will learn how to:

  • Navigate California Rule of Professional Conduct (Organization as Client) and related confidentiality and privilege rules
  • Preserve privilege when business and legal advice overlap
  • Manage conflicts across subsidiaries, affiliates, and executives
  • Deliver effective Upjohn warnings during investigations
  • Avoid multi-jurisdiction and technology-competence pitfalls that can expose in-house teams to risk

Whether you advise leadership, manage compliance, or oversee internal investigations, this one-hour program offers clear, California-specific guidance to help you protect your organization—and your professional license—with confidence.  (It’s also worth 1 hour of MCLE Ethics credit!).

By the end of this program, participants will be able to:

  1. Apply California’s Rules of Professional Conduct—especially Rules 1.6, 1.7, 1.9, and 1.13—to the unique context of in-house practice, where the client is the organization
  2. Preserve attorney-client privilege and work-product protection in communications that mix business and legal advice, including those involving consultants, affiliates, or public relations professionals
  3. Identify and manage conflicts of interest that arise from dual roles, complex corporate structures, or concurrent representations of executives, subsidiaries, and affiliates
  4. Conduct privileged internal investigations ethically, including delivering effective Upjohn warnings, maintaining confidentiality, and complying with California’s two-party consent recording laws
  5. Recognize and mitigate emerging ethical risks in multijurisdictional practice and technology use, including data privacy, AI tools, and remote legal work across state lines

Prosecutors Who Led the Investigation into January 6: Lessons for Large-Scale Litigation

Hear from two high ranking former federal prosecutors who managed the prosecution of the January 6 attack on the U.S. Capitol.  This was the largest investigation in Department of Justice history, involving over 1,500 and a team of hundreds of attorneys and investigators.  In this program, two leaders of the DOJ’s investigation -- the former Chief and Deputy Chief of the DOJ Capitol Siege Section -- will distill lessons learned from managing this litigation of an unprecedented scale.  While the attack on the Capitol may seem like a unique event, the challenges the investigation posed—relating to topics such as management, settlement approach, ediscovery, and team organization—have broad applicability to large-scale litigation of various types.

Speakers:

Alexis Loeb, partner at Farella Braun + Martel and former deputy chief of the DOJ Capitol Siege Section

Gregory Rosen, shareholder at Rogers Joseph O'Donnell and chief of the DOJ Capitol Siege Section
