  • Recent data privacy and security legislative and enforcement developments, how new comprehensive health information privacy laws will affect businesses, and look ahead to what regulators and legislators will be doing in 2024.
  • Strategies to increase chances that defense fees from company litigation are fully reimbursed by insurers, and to protect sensitive information developed during the defense of litigation that could be used by the insurer or underlying plaintiff to increase company exposure.

Historically, the Indian judiciary has been perceived as a tardy jurisdiction, primarily, due to lengthy trials and inordinate delays caused to enforce foreign judgements and awards. In the past few years both, the Indian legislature and judiciary has taken few initiatives to uplift the sentiment of foreign investors / litigants. Few legislative amendments coupled with some landmark cases have been effective and helpful in expediting enforcement actions in Indian courts. Nevertheless, it is imperative for a foreign entity to adopt an impeccable legal strategy when it comes to enforcement of foreign judgements and awards in India. Healthy lawyers are more effective lawyers.  Promoting mental health on an individual and institutional basis can enhance productivity, motivation, retention, as well as reducing absenteeism, turnover, and the risk of legal malpractice. While some stress may be inherent in the legal profession, strategies to manage stress are not only helpful, but also necessary to our competence in the legal field in the long term.  In this presentation, we will discuss studies regarding lawyer wellbeing, how stress affects lawyer competence, why lawyers are prone to stress-induced disease, and strategies to improve well-being.
