Session I — Winter Primer: Ethics Issues for In-house Lawyers…The Gift that Keeps on Giving

In-house counsel face issues relating to conflicts and ethics on a daily basis – some with which they contend regularly and others which they may merely brush up against.  With the evolving nature of the professional responsibility and ethics field, it is important to stay abreast of new developments in order to identify and address issues as they arise, as well as to take measures to guard against more systematic problems.  The panel will provide insight and advise on some of the more prevalent issues confronting in-house counsel as well as share best practices supported by the Rules of Professional Conduct and recent case law.  As part of the discussion, the panel will address ethical issues for lawyers with dual roles in a company and will cover and the multi-jurisdictional practice of law in light of remote work and in-house practitioner licenses.  They will provide considerations for in-house counsel in protecting privilege and work-product, including what happens when an in-house lawyer is a witness, and guidance on what to do when conflicts arise within your company, such as how to advise employees in a personal capacity and represent affiliates in transactions with the parent corporation.  Lastly, they will address the ethical issues that in-house counsel must consider when they conduct an internal investigation or use the results, as well as the increase in using non-lawyer experts in light of the expansion of technology, including cloud services, cross-border data arrangements, and bring-your-own device policies.

Session II — Cancel Culture at Work: Best Ethical Practices and Practical Tips to Reduce Risks Related to Employee Speech

The CEO was tagged in an after-hours post from employees criticizing the lack of action on a social issue.  What can the company do next?  Join a discussion about the ethical issues to consider and the potential legal claims a company may face when employees speak out, either at work or online. This webinar will offer best practices consistent with ethical rules and labor laws, and outline tips to avoid the speech-based civil claims that can arise in both corporate and public forums.

Our devices are dangerous…there are issues with “working from anywhere”…and artificial intelligence is causing all sorts of nightmares.  In this program the CLE Performer, Stuart Teicher talks about all of the latest dangers, including stolen devices and Rule 1.6(c), the dangers of autocorrect and Rule 4.4(b), and more.

The Agenda for the 23rd Annual Event will vary slightly from years past. With many upgrades for this 23rd Annual in-person event, we are thrilled to announce that our golfers will be able to enjoy Houston's premier PGA golf course, Memorial Golf Course.  Reopened and totally upgraded after a year-long closure, this popular in-town muni sports fascinating green contours, modest but strategic bunkering, and acres of short-grass runoff around putting surfaces. The Original John Bredemus routing from 1936 has been tweaked some to make betters of the basically flat site, with lots of understory and trees removed to expose the ravines and make it spectator friendly for the PGA Tour's annual Houston Open. The work by architect Tom Doak was enhanced by consulting of 4-time major winner Brooks Koepka. Together, they have produced a golf course that tests everyday players and elite golfers.

Not to be outdone by golf, our spa attendees will see increased amenities and time at Trellis Spa at The Houstonian Hotel.  Trellis spa boasts as a Mediterranean style spa surrounding a courtyard that offers a beautiful, natural garden environment seen through large windows located throughout the spa.  In the newly renovated spa, our attendees will choose from massage, facial, manicure and pedicure treatments. ACC Houston members and sponsors will also have their choice of attending a floral design class sponsored by Kean Miller.  Yoga and tennis lessons by the pros at The Houstonian will also be options for our spa attendees.
