Regulators are scrutinizing third-party relationships maintained by financial institutions, particularly with FinTechs, and the associated operational, consumer protection and compliance risks – including anti-money laundering risks.  In the last few years alone, regulators have announced several consent orders involving banks and their third-party risk management practices.  The values of speed, cost savings and consumer convenience can compete with effective risk management.  The panel will discuss common themes in recent enforcement actions, third-party risk management, and the outsourcing of compliance obligations.

ACC Northeast and Downs Rachlin Martin PLLC are pleased to present our next partnered webinar to talk about the ever-expanding universe of state privacy laws.

In 2020, a wave of state privacy legislation began in the U.S. with the passage of the CCPA in California.  Other states quickly began to follow suit and, as of July 2024, there are now 19 states that have jumped on the band wagon, with others waiting in the wings.  It is important for in-house counsel to understand these state privacy laws, as they pose a wide variety of compliance challenges to affected businesses that, in some cases, may have multiple layers.

DRM attorney Matt Borick will provide an overview of these state privacy laws, focusing on their general requirements for affected businesses.  He also will discuss the effort in Vermont to enact a privacy law and the issues that derailed the legislation.
