In this presentation, we will discuss best practices for engaging in settlement negotiations both before and during litigation.  We will discuss tips regarding topics including when to engage outside counsel, under what circumstances should pre-litigation settlement discussions be pursued, how to select (and when to use) a private mediator, and valuing risk exposure.

This program will include a panel of experienced in-house M&A counsel discussing best practices for preparing and running an effective integration process for acquisitions. Key topics will include mapping out integration objectives, managing the integration planning process throughout the course of the transaction, implementing Day One integration measures, and executing the integration plan for post-closing success.

Pension regulators in Canada are transforming how they regulate.  There is increased interest in risk, particularly in areas like cybersecurity and climate change. Ontario’s pension regulator can now levy administrative monetary penalties for not only late filings but general breaches of the pension legislation, and has announced a new plan examination process. The federal regulator has reorganized and is issuing guidance applicable to both pension plans and other regulated entities, such as banks, despite differences between the two. AI will no doubt be the regulatory radar. The new priority for pension plan deficits in employer insolvencies may also have an impact.
