Part III: Best Practices in Negotiations — How to Optimize Success at the Table

In this interactive and tailored session, the presenters will discuss best practices and strategies for successfully responding to real-life challenges in negotiation, based on examples shared by the presenters and the audience. The presenters will bring research and practical experience to bear and share specific pointers, tools and best practices for effectively interacting across the table with your negotiation counterpart, and will invite participants’ views as well.  Topics for discussion may include:

  • Understanding the Dynamics of Compromise;
  • Building Rapport and Effective Advocacy;
  • Managing an Imbalance of Bargaining Power and Difficult Behaviors at the Negotiation Table.

Part I: Collaborating & Preparing for the Negotiations
(PLEASE NOTE THAT THIS EVENT IS NOW TAKING PLACE VIRTUALLY, AND AT A NEW TIME.)

 

Attorneys from Bernstein Shur, Kevan Lee Deckelmann and Kat Joyce, will be joined by Kelly Whetstone, Deputy General Counsel at Foreside Financial Group, as they discuss the collaborative process between in-house and external counsel in preparing for a critical negotiation in various contexts, including M&A, regulatory applicability and/or approvals and mission critical contracts.

This virtual session will use real-life “war-stories” to illuminate and answer in-house counsel questions on negotiation strategy:

  • Better ways to align on objectives;
  • How to gain critical insights to aid in negotiations;
  • Identifying Strength & Weakness in negotiation positions;
  • Leveraging past experiences in dealing with other side.

This discussion will touch on recent developments and trends, and provide specific action items -- and a few tricks -- in safeguarding a company’s trademarks and copyrights. Ned Himmelrich will share some best practices for corporate counsel to use in protecting the company’s brands and creative works. Topics will likely include the following:

    • Benefits of registering trademarks and copyrights
    • Social media necessities
    • Gathering the Bundle of Rights
    • Constant vigilance, inside and outside
    • Cybersquatters and Reverse Domain Name Hijacking
    • Some tricks for trademark applications

Prosecuting or defending a broad range of matters can often turn on evidence that lawyers often don’t realize exists. Matters involving trade secrets, employee theft, family law, workplace harassment, noncompete clauses (among others) can hinge on the recovery of deleted data, data on mobile devices, or other ephemeral sources (social media, for example). Join us to learn about what types of evidence can be uncovered; how to defensibly and efficiently preserve the data; and how to analyze the data to your competitive advantage.

The U.S. Supreme Court’s decision in Daimler in 2014 changed long standing views of general jurisdiction in the United States. The impact of that decision is still being felt today. This CLE will review some of the cases that followed Daimler and discuss their impact on corporations. In addition, this CLE will review various state business registration statutes and their impact on the jurisdictional analysis. We will discuss what issues corporations need to consider when dealing with the changing case law and what risks are posed by registering to do business in other states.

Yes, after a wait of over a year, the ACC is back in action with an all outdoor golf and wine tasting event! (Sorry no spa this year.)  We will hold our 18th Annual Golf/Wine Tasting Scholarship Outing on Tuesday, September 28th, at the Rolling Road Country Club, at 814 Hilltop Road in Catonsville.

As noted above, we plan to hold all portions of the event outdoors. However, with the everchanging rules due to the delta variant, we may be forced to limit some activities.

As of now, we will follow the CDC guidelines--if you are vaccinated and outside, you may go without a mask. If you are not vaccinated, you should wear a mask unless you are eating or drinking--and, will maintain some social distance while doing so.

In addition, we welcome all to wear masks if that is more comfortable for you (vaccinated or not). 

If you are inside to use restrooms or changing rooms, then masks must be worn. 

We ask that all who attend be mindful of the different levels of comfort of every member and respect those who wish to wear a mask, keep their distance, avoid hugs, handshakes, fist or elbow bumps, etc.

Please join your Baltimore ACC chapter colleagues and attorneys from the Bar Association of Baltimore City Senior Legal Services to help prepare simple wills, general powers of attorney and advanced medical directives for pre-screened, financially qualifying senior citizens on Thursday, September 9 from 8:30 am to 12:30 pm at the B&O Railroad Museum Outdoor Pavilion.  This is an easy and low stress event!

No estate planning experience is required and there will be no continuing attorney-client relationship with the client.  Reference materials will be sent out to you by email prior to the event and training will be provided at 9:00 am that morning before the clients arrive at 9:30 am.  Laptop computers pre-loaded with forms, printers, notaries and experienced estate planning attorneys will all be provided.  

Coffee, juice, breakfast pastries and boxed lunches will be provided.

Please let us know if you are licensed to practice in Maryland.  A Maryland license is not required to volunteer.  Those not licensed in Maryland will be paired with Maryland bar members and two attorneys will be assigned to a client.

COVID-19 Protocols:  All volunteers and clients will be required to wear masks (even though this event will take place in a well ventilated outdoor pavilion).  Work stations will be sanitized between clients.
