The Biden administration is all-in on a “whole-of-government” approach to competition policy. On the heels of a wide-reaching executive order and appointments of Federal Trade Commission (“FTC”) Chair Lina Khan and Department of Justice (“DOJ”) Assistant Attorney General Jonathan Kanter, the government has threatened lawsuits across numerous industries under novel theories of antitrust harm.

In this program, we will review the current antitrust landscape, the recent actions taken by the FTC and DOJ, and additional developments we anticipate from the agencies going forward, including anticipated effects on non-compete agreements, an increased volume of FTC investigations, and potential FTC rulemaking. We will hear the perspective of in-house counsel about how to navigate a company through these complex and changing issues, with an emphasis on how the changes impact your antitrust compliance program.

Presented by Joe Miller, Member and Co-Chair of the Antitrust Practice Group at Mintz, Tinny Song, Associate at Mintz, Michael Spector, Deputy General Counsel at AHIP and Helen Lee, Senior Compliance Counsel at Accenture.

1.5 Hours of VA MCLE pending.

During this presentation, a seasoned panel will discuss the challenges faced by prime and subcontractors in the federal marketplace.  Topics will include effective (back-to-back) flow-down of prime contract provisions, exclusivity restrictions, and appropriately-scoped employee non-solicitation and intellectual property provisions. We will discuss these and other common issues that arise in a prime-subcontractor relationship, the importance of a well-drafted subcontract, review some case studies and provide real-world examples of the good, the bad and the ugly of contract drafting as well as provide our thoughts on best practices.

Presented by Paul A. Debolt, Taylor S. Chapman, and Dismas Locaria, Partners with Venable LLP, Kendall A. Lucas, Principal and Associate General Counsel, and Government & Public Serviced (GPS) Federal OGC Leader at Deloitte, and Christian Scott, Associate General Counsel at Vectrus.

1.5 Hours of VA MCLE pending.

While most of our focus over the last two years has been on COVID-19 related developments, New York State and New York City employers also must ensure compliance with other legislation impacting the workplace.  During this session, we will discuss recent legislative requirements and regulatory guidance impacting how New York employers conduct their business in 2022 and beyond.  Topics include:

  • Enhanced whistleblower protections

  • Electronic monitoring notice requirements

  • Artificial intelligence in the hiring process

  • The latest on marijuana in the workplace

  • Pay transparency

  • Updates on wage and hour issues

  • Restrictive covenants

  • COVID litigation and best practices update

UPDATE ~ DUE TO UNFORESEEN CIRCUMSTANCES, THIS EVENT WILL NOW BE HELD VIA ZOOM.

If you would like to volunteer and are unable to attend the career panel, we invite you to join us for the Speed Round Discussions. We ask that volunteers log on no later than 6PM to participate.

Come help us shape the minds of the next generation of attorneys. We are looking for a few ACC-NYC attorney volunteers and a select number of Fordham Law students to join us for the Career Day Panel and to participate in our speed networking rounds with the Legal Outreach students.

WHO:

Legal Outreach has developed a Professional Development and Exposure Program (PDEP), the purpose of which is to help prepare high school students for its Summer Internship Program – a five-week program where rising sophomore students are placed at public interest, judicial, financial, and private law firms with the hope that they will be inspired to pursue professional careers, particularly within the field of law. Beginning July 5th, students will begin serving as summer interns at various law firms and legal departments in the New York City metropolitan area.

WHAT:

To support Legal Outreach’s PDEP, the ACC-NYC, Mintz and Fordham Law School will host a Career Day Panel and Speed Networking event at Fordham Law School on Wednesday, June 15, 2022 event from 5 – 8PM (registration begins at 4:30). The goal of the Career Day Panel and Speed Networking event is to expose the students to various legal careers from a mix of in-house attorneys and law firm partners and to help students hone their conversational and networking skills as they will be working directly with attorneys and other legal professionals throughout the summer. For many teens, the idea of initiating and maintaining a conversation with an adult is daunting, to say the least, so the more practice and constructive feedback they receive, the better.

HOW:

To prepare students for their internships, they will participate in 3 rounds of 15-20 minute speed-communication sessions, similar to speed-dating. Approximately forty-one students will be paired in groups of 2 students with 2 volunteer attorneys (and some may include a 1 volunteer attorney and 1 Fordham Law School student) for each round and will be assigned to a dedicated breakout area for the sessions. In each round, there will be three timed discussion topics: (1) Getting to Know You; (2) Choosing Colleges and Careers; and (3) Hot Topics:

  • Getting to Know You (5 min) - students will be assessed on how well they introduce themselves (first impressions), discuss their personal interests and ask questions about the attorneys’/law students’ personal background while sharing information about their own.

  • Choosing Colleges and Careers (5 min) - students will be assessed on how well they engage the attorneys/law students with questions pertaining to their high school, college, law school experiences and their current position. Students will also be expected to discuss their career aspirations.

  • Hot Topics (5 min) - students will be assessed on their knowledge of current events and how well they engage attorneys/law students in discussions on controversial issues or contemporary topics, such as privacy and social media.

At the end of each round (5 min), the attorneys/law students will give feedback and share some tips on how to be an effective conversationalist and networker.

The technology and law in this area are rapidly evolving and not every lawyer can be an “expert” on e-discovery. There is a lot to know – some of it highly technical. By the same token, blind reliance on outside counsel and/or discovery companies to protect company interests—or the litigation budget—can be a costly mistake.

Here are essential tips for in-house lawyers and other legal professionals who are involved in the e-discovery process. This course will cover:

     • Processes that your company should consider handling in-house, where outside counsel can help, and when to engage e-discovery providers;

     • The critical steps to take as soon as claims or investigations are initiated and anticipated;

     • The questions you should be asking—and instructions you should be giving—your outside counsel and e-discovery companies;

     • How to turn e-discovery from a potential liability and pure cost center into a litigation advantage;

     • The most common e-discovery mistakes that can cost you big – in dealing with adversaries, as well as your own internal and external teams; and

     • What you should be doing NOW to make sure that your company is “litigation ready” in advance of future claims or investigations.

If you only have an hour to learn what you need to know about e-discovery, this is where you should invest it!
