Join Norton Rose Fulbright for a presentation entitled “Life After Breach”. Data breach headlines have dominated the news cycle in the last 24 months. Nowadays, regulators are taking a hard look at the breach and seizing the opportunity to do a full-scale review of a company’s cyber, privacy and data practices. As a result, organizations need to be prepared to bring the receipts and explain why and how data was being collected, processed and retained. Regulators will look for an explanation of data collection and deletion practices, Privacy by Design, deidentification, and other privacy and security-friendly choices that could have mitigated the fallout from a breach.

While many countries throughout the world have enacted comprehensive consumer privacy laws, the United States has not been successful in establishing a federal privacy framework in the last decade. As a result, many states have begun enacting their own consumer privacy frameworks. This year, however, the American Data Privacy and Protection Act (ADPPA) became the first federal legislation to gain traction in Congress. While it faces many hurdles prior to enactment, if enacted, the ADPPA will fundamentally change privacy law in the United States. Even if not enacted, this progress represents a clear indication that federal privacy legislation may soon be on the horizon while state privacy laws continue to emerge.

Join Husch Blackwell and ACC-Wisconsin for a discussion on the status of the ADPPA and the current status of privacy laws in the United States. We’ll also provide recommendations on how to prepare for the continued uncertainty in the privacy regulatory space.

Topics:

  • What is the current consumer privacy landscape in the United States?
  • How will that change if ADPPA is enacted?
  • What is the current status of the ADPPA?

Presenter: Mindi S. Giftos, Partner, Husch Blackwell
