The post-employment non-compete landscape continues to change all over the country. At the federal level, the Federal Trade Commission (FTC) has proposed a rule that would ban non-competes nationwide, spurring multiple legal challenges. A Texas federal judge will decide a challenge to the FTC non-compete ban by July 3, 2024. On the state level, several state legislatures passed bans that were vetoed; California expanded the reach of its non-compete ban; and, over recent years, numerous states (including Illinois) have placed limitations on the use and enforcement of non-competes.
