During the 2021 legislative session, Alabama legislators passed a medical marijuana bill that was subsequently signed into law by Governor Ivey. While this is a new issue for Alabama-only employers, the recent expansion of recreational and medical marijuana legalization laws across the country has been swift and significant. While employers may think that “marijuana” is only a drug testing issue, it actually is very broad and touches on a wide variety of workplace topics, including OSHA, statutory compliance, disability discrimination, government contractor status, federal regulation compliance, workers’ compensation, employee privacy, and public policy—with workplace health and safety being a critical consideration relevant to all of these topics. Join us as we talk about Alabama’s new medical marijuana law and, more generally, this complex, rapidly-changing, and (at times) controversial topic. We will discuss the current legal landscape, the evolution of marijuana legalization and forward-thinking concerns and issues, tools to assist employers in remaining legally compliant, and practical advice and tips to help employers deal with workplace marijuana issues.
