CHECK, WIRE, AND ACH FRAUD: PREVENTING LOSSES AND MANAGING LIABILITY

Payments fraud related to checks, wires and ACH transactions is a constant concern for businesses across all industries. Fraudsters have become increasingly sophisticated in exploiting weaknesses in financial transaction systems, leading to substantial financial losses and significant legal exposure. For in-house counsel, the challenge lies not only in advising on preventative measures but also in navigating the legal ramifications and liability-shifting rules of potential fraud incidents.

This presentation will explore the types of fraud schemes commonly associated with checks, wire transfers and ACH payments, focusing on how in-house counsel can implement effective fraud prevention strategies. It will cover key preventative tools such as positive pay and dual control and provide a nuanced analysis of the liability that accompanies their use. It will help in-house counsel understand the steps that must be taken in the event of a suspected fraud incident and walk through the complicated legal maze of liability-shifting rules for different payment types. In-house counsel will be equipped to design and implement effective fraud prevention programs while managing the responsibility that these tools may entail. And in the event fraud does happen, in-house counsel will have a primer on the rights, obligations and liability-shifting rules that will determine who bears the loss.

Pro Bono Event: Limited Conservatorship Clinic 

IN-PERSON EVENT: Children’s Hospital of Orange County (CHOC) Bill Holmes Tower, 455 S Main Street, Orange, CA 92868 

Saturday, January 11, 2025 (RSVP by Jan 7th!)

8:30 AM – 1:30 PM PT

ACC-SoCal will partner with Elder Law and Disability Rights Center at CHOC to assist parents of individuals with developmental disabilities to obtain a limited conservatorship so they can retain some of the decision-making rights even if their child is over 18 years old. 

No prior experience necessary: ACC members will be provided with a short on-demand training video that they can view on their own time before the clinic (MCLE credits pending). They will then be assigned a family and review the packet submitted by the family. At CHOC, members will assist the family in completing the limited conservatorship forms for e-filing. Optional: if you want to assist the family after the clinic through their entire court process, you can sign onto the case with Elder Law and Disability Rights Center as pro bono counsel. 

Breakfast pastries, coffee, and bottled water will be provided. Please bring a laptop or iPad to the clinic and wear your ACC-SoCal shirt (if you don’t yet have an ACC-SoCal shirt, they can be provided).

"Private Eyes Are Watching You:  U.S. and International Privacy Laws Relating to Employee Monitoring "

In a post-COVID world, hybrid and completely remote employees have become increasingly commonplace, with employers struggling to find ways to monitor productivity and availability, ensure the security of confidential data and sensitive personal information, and encourage compliance with legal requirements and employment policies.  Increasingly, employers are exploring remote monitoring options, including monitoring methods such as time tracking and email monitoring, video surveillance, keylogging, application monitoring, geolocation tracking, and the installation of monitoring software on company-issued devices, as well as mobile device management software for personal devices used for business purposes. The legality of the use of such monitoring techniques varies both within the U.S. and internationally.  This session will help employers to identify the commonalities and differences between U.S. and international laws relating to employee monitoring.
