On May 12, 2025, the U.S. Department of Justice (DOJ) announced a new white-collar enforcement strategy, outlining ten priority areas, including several with a specific focus on China and Hong Kong SAR.

Just weeks later, on June 9, 2025, the DOJ issued updated guidelines for federal prosecutors investigating and enforcing the Foreign Corrupt Practices Act (FCPA), effectively ending a four-month pause in FCPA enforcement activity.

While the new Guidelines do not mention China explicitly, they reinforce the Trump administration’s “America First” emphasis on economic security. Collectively, these recent developments signal a more assertive enforcement posture than many had anticipated — raising the stakes for Mainland Chinese and Hong Kong companies operating abroad, as well as international businesses with operations in Asia.

Join us for an in-depth discussion placing these changes in the broader context of global trade tensions, rising tariffs, and expanding sanctions. Our panel will explore the practical implications for corporate compliance, strategies for mitigating legal and reputational risk, and how to respond proactively to the evolving U.S. enforcement environment in Asia.

Event Details:
Date: Thursday, 28 Aug 2025
Time: 12:30 pm – 2:00 pm (Light Lunch | R
egistration opens 12:30 pm; Seminar starts 1:00 pm)

Location: Debevoise Hong Kong Office: 21/F AIA Central, 1 Connaught Road Central, Hong Kong

NOTE: CPD accreditation has been applied for and is subject to approval by the Hong Kong Law Society. Please ensure you sign the registration sheet at the start of the event and attend the full duration of the seminar to qualify for CPD point(s).

Participants will meet via Zoom from 4:00 PM to 5:30 PM. We’ll talk through some of the lessons from Roger Fisher and William Ury’s book, Getting to Yes – but don’t worry, there’s no need to read the book for this session.

Here are some resources highlighting elements of their approach that you may wish to explore as you prepare for our discussion:

We hope you’ll come ready to share your own experiences and what negotiation strategies have worked well (or maybe not so well) for you!

The program is free and open to ACC members and in-house counsel guests.

*The mission of the ACC MN Sounding Board is to foster the professional development of ACC MN members seeking to learn ways to interact more effectively with their business partners and promote personal leadership and growth.

As AI reshapes entire industries, federal courts are beginning to define the legal boundaries.

Generative AI is transforming industries, but it is also raising urgent legal questions. Two recent federal court decisions involving Meta and Anthropic are helping define how copyright law applies to the use of books and other creative works in AI training. These rulings are beginning to shape how companies develop, license, and use AI tools.

In this webinar, Knobbe attorneys Mark Lezama and Lincoln Essig, along with Sam Olive, Senior Director/Associate General Counsel, Intellectual Property at Cisco, will break down what these cases mean for in-house counsel. They will examine how courts are interpreting fair use in the AI context, and what steps companies can take to reduce legal risk in this evolving area.

Key topics will include:

  1. How courts are addressing the use of unauthorized and digitized books in AI training
  2. What qualifies as transformative use and how market harm is being evaluated
  3. What companies should include in AI-related contracts to mitigate risk
  4. Why audit rights, indemnification, and output controls are important

This session is designed for legal teams across industries, including technology, media, healthcare, finance, and manufacturing. If your company uses or integrates AI, this webinar will provide valuable insights to help you stay informed and protected.

Hosted by:  Knobbe Martens and ACC Southern California
