Cyber attackers didn’t stay home during the COVID-19 public health emergency; they’ve continued to be up to no good. The bad guys keep attacking businesses of all types, and their methods are evolving. Join us to discuss the data privacy and security issues keeping us all up at night.
We will review recent international, state, and federal regulations, developments, and enforcement related to data security issues; preparing for and responding to different types of cyber-attacks, including by leveraging data security tools like certifications and frameworks; and best practices for health care entities of all types with regard to data governance.

 Insurance is one of your Company’s most important assets. This program will explore how companies can use their liability insurance policies most effectively.  We will cover practical tips about the purchase of insurance and the submission of claims.  We will then review insurance coverage for emerging liabilities including Covid 19 and cyber.  The final portion of the program will focus on recent developments under Delaware law in connection with directors and officers’ insurance policies and several recent court decisions of significance. * Legal differences between FDA’s vaccine approval process and emergency use authorization (EUA) process;
* Employer decision to incentivize vs. mandate the COVID-19 vaccine for employees;
* Employer on-site vs. off-site vaccination clinics;
* Preparing employee messaging regarding management’s decisions about the vaccine;
* Developing policies and best practices for documenting accommodations, collecting proof of vaccination, and data information storage and usage.

This interactive program will provide a deep dive into the challenging issues that in-house counsel confront in handling employee whistleblower claims and investigations.  The program will provide a series of video scenarios based on cases “in the headlines” that provide a launch for panel and participant discussion.
The program will explore the legal and ethical issues that arise in internal investigations of whistleblowers, including:
* The obligation to report up to the Board the complaint and the results of the investigation;
* The retention of “independent” counsel to conduct the investigation;
* The preservation of the attorney-client privilege for interview notes and reports;
* Limitations on the ability to restrict complainant and witness communications and self-help discovery; and
* Reducing the risk of whistleblower retaliation claims during and after the investigation.

The EU-UK Brexit deal approved on December 30 brought some welcome clarity to the treatment of personal data now that UK GDPR is a wholly separate legal regime from EU GDPR. The deal also provides for free trade of goods between EU and the UK.

In this session we will explore the practical implications of:

* The Schrems II decision and invalidation of the U.S. Privacy Shield program and related guidance and interpretation

* The "grace period" of up to six months allowing transfers of personal data from the EU/EEA to UK

* EU approval of new Standard Contract Clauses and the need for "additional measures" following the Schrems II ruling

* Overseas' organizations' need for separate Article 27 representatives for EU/EEA and UK

* Data subject rights and breach response under UK GDPR and GDPR. Is there a risk of double enforcement?
