"Consumer Privacy Legislation Update:  What In-House Counsel Need to Know"

On January 1, 2023, amendments to the California Consumer Privacy Act (CCPA) went into effect that ended a 3-year exemption for data in the employment context.  For PA-based companies that are subject to the CCPA, this can be significant, as it means that California employees, job applicants, and independent contractors now enjoy the same protections and rights under the CCPA as all other consumers. The sudden end to this exemption has left businesses scrambling to bring their HR data practices into compliance. The intervening year has been a rollercoaster ride for employers hoping to stay on top of regulations which so far have lacked any direct guidance on how rules written for the traditional consumer context can be employed in the unique and often more complex employment context. Adding to the confusion is a series of developments, including a recent court order delaying the enforcement of the updated CCPA regulations until March 29, 2024, and a pending appeal of that order that is currently pending.  Further complicating matters, new consumer privacy laws have taken effect in Virginia, Colorado, and Connecticut, and more have passed and are due to take effect in the coming years, creating a challenge to companies trying to harmonize the various requirements across jurisdictions.  Join Risa B. Join ACC St. Louis and Ogletree Deakins for a 1-hour CLE on Leave Accommodations Outside of the FMLA. 

The federal Pregnant Workers Fairness Act requires accommodations for normal pregnancies and became effective June 27, 2023. In combination with the ADAAA amendments (which make it easier to prove disabilities, even for temporary conditions), these developments arguably have extended FMLA protections to employees immediately upon the onset of employment, without any length or service requirement and potentially without a 12-week limitation on leave.

Join this session for a discussion of leaves as an accommodation even without meeting FMLA eligibility requirements.
