Join Babst Calland Corporate and Commercial Attorneys Mary Binker and Ben Clapp for a two-hour CLE that will provide an in-depth review of legal considerations associated with the purchase and sale of environmentally distressed properties from both the Purchaser and Seller’s perspectives.  This program will first provide an overview of the framework of environmental laws establishing liability for the ownership or operation of contaminated properties, followed by how these laws and existing environmental conditions on the subject site can impact a party’s diligence considerations and inspections.  It will then turn to transaction structures and contractual mechanisms for allocating environmental liabilities between the parties.  Finally, the program will also cover voluntary action programs, brownfield grants, and other regulatory programs aimed at assisting with returning environmentally challenged properties back to productive use.
