Over the past year, scrutiny in the advertising world has increased significantly and centered on environmental, social, and governance (ESG) issues. Although ESG advertising grey areas remain, the fog of confusion is slowly lifting. This ACC Webcast will explore how recent lawsuits and National Advertising Division (NAD) decisions provide useful guidance and help streamline the rules for companies to safely advertise their ESG goals.

Corporate litigation from Patent Assertion Entities (PAEs, sometimes called “patent trolls”) continues to increase across all industries, resulting in a major drain on company time and money. As stewards of the company's in-house legal resources, it is becoming increasingly important for corporate counsel to remain vigilant of patent troll activity to protect the organization. This need will continue to grow in importance as the economic environment becomes increasingly uncertain. During this session, we will explore the latest patterns in patent troll activity and effective mitigation strategies.

Data is an asset similar to intellectual property, isn't it? Of course it is. Data is valuable, and can and should be exploited, which is usually done through a data license. Data licenses are similar to other types of IP licenses, but data licenses often present unique issues that must be addressed, including data ownership and use, as well as the treatment of the original data set, data derived from the original data set, and usage data. Data licenses can and should materially circumscribe the ways in which data sets may be exploited by others. This session will provide an overview of the issues involved when negotiating data licenses.
