ACC ConnecticutWe will share best practices and how to respond to and protect your interests “WHEN THE GOVERNMENT COMES KNOCKING.” In this program, we will discuss what organizations need to consider when the government approaches you and also discuss various strategies to prepare for such situations.
Our legal and IT leaders, a former United States Attorney and a former Senior Network Analyst at a large financial institution, have spent their careers advising businesses, non-profits, and individuals on how to react and prepare ahead of time for government inquiries.
We will address such topics as subpoenas, civil investigation demands, legal hold notices, what constitutes privilege, the data perspective, and the role of a D&O Policy.

Terrance P. Flynn, Partner and Leader of the Government, Compliance and investigations Practice Group, Harris Beach Murtha
Terry is a former presidentially appointed United States Attorney for the Western District of New York. He represents businesses and individuals across industries in both civil and criminal government investigations which include conducting internal corporate probes, litigation, grand jury matters and independent monitorships.
Terry also litigates in federal and state courts on behalf of a diverse array of clients among the Fortune 50 and large privately held companies, including such companies as Walmart, Facebook, United Technologies, United/Continental Airlines, Westlake Chemical Corporation, Skyryse, UBS Financial Services and the Buffalo Sabres, in such areas as commercial litigation, product liability and personal injury litigation, and government compliance. Terry’s representation of United Technologies resulted in Harris Beach Murtha being acknowledged among the Go-To Law Firms® for 2014 in Contracts Litigation as published in Corporate Counsel magazine.
Dawn M. Russell, Chief of Information Governance and Risk Management, Harris Beach Murtha
Ms. Russell develops, establishes, and maintains standards, procedures, guidelines, promote and support the security of computer systems at the firm and its
ancillary businesses. She works closely with IT to identify, implement, and test security and related controls. She also develops governance programs for client data to meet requirements relative to security of protected information. Ms. Russell is a member of the Cybersecurity Team and is an ISACA Certified Information Security Auditor and ITIL v3 certified.
Ms. Russell has a wealth of professional information technology experience related to security, compliance and management of information in the banking industry. She was previously team leader/vice president of a large financial institution, responsible for infrastructure risk, vendor and high severity incident management. She developed and delivered a technology risk compliance assessment program designed to pro-actively identify, rate and remediate risk. Ms. Russell also maintained technology compliance materials, and developed a comprehensive, risk-based technology audit management service to achieve successful closure of identified risks.
