Program Description:  Collectors, artists, and corporations alike share a common interest in careful planning to protect their art collections well into the future. Channah Norman, of Shook, Hardy & Bacon, will describe several recent high-profile art law cases that underscore the importance of such planning and the special considerations associated with art assets, including possible restitution and repatriation claims, artists’ moral rights protections in commission agreements, fakes and forgeries, and best practices in commercial art market transactions.

Rosemary Ringwald, the Head of Art Planning Services for the West Coast at Bank of America, will provide an overview of the important planning considerations for the long-term protection of an art collection. In particular, different tax implications apply to the sale of art from a collection, establishing a family trust, or making a charitable donation. Additional attention will be given to some of the challenges specific to art collections, including authentication, attribution, title, condition, fair market value, and provenance.
