While trial practice has been in decline for decades, used correctly trials remain a valuable tool to reduce exposure, better define damages, and reset the paradigm of settlement negotiations. Knowing when a trial path is in the best interest of a company is key to effectively utilizing and capitalizing on this strategy. Properly evaluating a case for trial can expand the available options and help to reduce future risks. This program will cover how trials can be effectively utilized, even in some of the riskiest settings, and discuss best practices for communicating the need for considering a trial as the best available option.
