By now, it is axiomatic that the attorney-client privilege applies to entities. Corporations, like individuals, enjoy the protection of the attorney-client privilege without distinction to lawyers who are in-house or outside counsel for an organization. Although the availability of privilege is undisputed, the administration of the attorney-client privilege in the case of corporations presents a patchwork of problems. Among those are questions relating to who speaks for the corporation, the nature of protected communications, and who can waive the privilege on the corporation’s behalf. In this presentation, we will unravel the issues on preserving corporate privilege and show you how to keep the confidentiality of your business communications from coming undone. 


Speakers

John M. Riccione is a partner in Taft’s Litigation practice. His practice involves the representation of businesses in a wide array of complex commercial disputes, including commercial and supply-chain transactions, UCC warranties and remedies, real estate, construction claims, trade secrets, computer fraud and abuse and labor and employment. He is a frequent speaker on the topics of Uniform Commercial Code remedies, contract interpretation as well as other commercial disputes.

William J. Serritella Jr. is the co-chairman of Taft’s Chicago Litigation Department. He is a commercial litigator who focuses his practice on banking, commercial and appellate litigation. Bill lectures on numerous topics, including commercial real estate workouts, Uniform Commercial Code issues, trial practice, appellate practice, contract law, sales commission protection acts, employment discrimination and alternative billing practices.

Brianna M. Skelly is a partner in Taft’s Litigation group, focusing her practice on complex commercial litigation. Brianna represents creditors, businesses and individuals in litigation arising from commercial transactions, employment matters and warranties.

Peter Carlson is Senior Counsel at Motorola Solutions, Inc., a global leader in mission-critical communications and analytics.  In 2000 he initially supported mobile phone product safety and regulatory compliance issues, eventually adding commercial support for the business' accessories' division. In 2007 Peter moved to a new legal role managing commercial and personal injury litigation matters for Motorola's government public safety and enterprise businesses. Motorola, Inc. split into two companies in 2011.  Peter stayed with the legacy, government public safety business, which was renamed Motorola Solutions, Inc. In addition to his management of various litigation matters, Peter has added back in responsibilities for product safety and regulatory compliance, as well as new support to the business on issues related to EHS and cyber, among other topics.
