ACC ChicagoCorporate America has responded to demands from employees, shareholders, and customers by building out programs of various sizes and types to emphasize diversity, equity, and inclusion in their organization. Recently, interest groups and individuals are pushing back on this trend, raising internal complaints and filing lawsuits challenging these initiatives. At the same time, single plaintiff and class action litigation alleging reverse discrimination is on the rise. In this panel, we will explore these trends and what to expect in the future, and we will provide practical advice about legal guardrails that ensure DEI programs can withstand this new scrutiny.
