ACC AustraliaRegulatory investigations and enforcement actions are running at unprecedented levels across Australia. Major regulators have been very public as to their priority focus including matters canvassing cyber security and cyber resilience, data management and disclosures concerning ESG, in particular climate change and the “greenwashing or greenhushing” debates.
It is crucial for in-house counsel to have a comprehensive understanding of various strategic factors that have the potential to significantly influence the outcome of a regulatory investigation.
This CPD event, hosted by Gilbert + Tobin’s Disputes + Investigations team in conjunction with ACC Australia, will explore a range of topics including:
- recent regulatory trends, including in relation to data breaches, greenwashing and crypto currency;
- working with your executive team and Board in anticipation of a regulators’ focus;
- the impact of regulatory actions on a company’s strategy and operations; and
- tips for in-house counsel when managing a regulatory investigation, including engaging with the regulator, preparing for compulsory processes, document and evidence management and stakeholder engagement.
Speakers
Philippa Hofbrucker, Partner, Gilbert + Tobin
Philippa is a partner in Gilbert + Tobin’s Disputes + Investigations practice. She specialises in complex commercial litigation, class actions, regulatory matters and government inquiries.
Philippa has extensive experience acting for ASX200 companies and individuals in regulatory investigations and enforcement actions by ASIC, ACCC, APRA, AUSTRAC and the OAIC. She has acted on numerous high-profile regulatory matters, including for Westpac in separate investigations by ASIC and APRA into matters arising from 23 million alleged breaches of AML/CTF laws and ASIC’s BBSW investigation and enforcement action, and is currently acting for clients in an enforcement proceeding by AUSTRAC and in an investigation by ASIC into matters arising from a cybersecurity incident.
Christiana McCudden, Partner, Gilbert + Tobin
Christiana is a partner in Gilbert + Tobin’s Disputes + Investigations practice. She specialises in commercial litigation and regulatory matters and has extensive experience representing clients in large state and federal court proceedings, investigations and Royal Commissions.
Christiana has acted in various complex litigation matters but also advises clients in a range of industries in relation to dealings and / or investigations by ASIC, ACCC, APRA and other regulators. Christiana acted for RI Advice in the proceedings issued by ASIC asserting breaches of financial services laws arising from cyber security incidents and has most recently been advising clients in respect of regulatory investigations concerning ESG matters and “greenwashing”.
Aparna Nanayakkara, Partner, Gilbert + Tobin
Aparna is a partner in Gilbert + Tobin’s Disputes + Investigations practice. Aparna specialises in complex litigation (including class actions), regulatory investigations and enforcement proceedings, and commercial disputes.
She has significant experience acting for listed companies, financial institutions and directors and officers in relation to major regulatory investigations brought by ASIC, AUSTRAC and APRA. She has defended multiple major ASIC enforcement proceedings, including high profile actions brought by ASIC against Westpac, Vocation, the former CEO of Vocation and Nuix, as well as the AUSTRAC proceedings brought against Westpac. She is also acting for Block Earner, an Australian fintech, in relation to ASIC ‘s investigation and subsequent enforcement action regarding cryptocurrency services.
