Data Privacy, Security, and Confidentiality for In-House Teams

How do cybersecurity and privacy issues play into the lawyer’s obligation to retain client confidentiality?  In-house teams work with large amounts of confidential and personal information on a daily basis. This session will provide ACC members with an overview of the ethical obligations relating to data protection, the risks associated with managing confidential and personal information, and day-to-day privacy and security considerations. Topics include an overview of Model Rule 1.6 (Confidentiality of Information) and how that translates into confidentiality practices and cybersecurity readiness, key laws related to data protection and privacy, practical steps for in-house teams to consider, the risks and implications of security events or confidentiality breaches, and ABA Ethics Opinion 483 (Lawyers’ Obligations After an Electronic Data Breach or Cyberattack).

Leveraging AI While Keeping Your Company & Hiring Practice Ethical

Artificial Intelligence (AI) can have many practical uses for businesses, but there are plenty of
potential issues to avoid. Issues include the EEOC’s recent guidance on using AI in hiring (issued in May 2023), which has left many in-house legal and human resources departments with questions about how, or if, AI
may be used to help in the hiring process. This robust session focuses on how organizations can ethically
leverage AI tools in their hiring practices, as well as watchouts for in-house counsel when updating
company policies (e.g., code of ethics, employee handbooks, and IT policies), data privacy
considerations, and DE&I. Participants will leave with proactive ways to limit exposure, minimize the impact of potential issues if they arise, and successfullyleverage AI to improve policies and procedures for their organization.

The Duty of Competency for In-House Counsel: Do You Know What You Need To Know?

After discussing the duty of competence, this session will apply ethical rules to assess real-world examples of questionable attorney conduct. The panel will also include perspectives from an in-house attorney with personal examples from their own experience on seeking out additional help and
guidance when tackling novel legal issues.
