2020 was a rollercoaster of a year, and not just for the most obvious reason.  The workplace landscape changed in many ways, with employers grappling with “working from home” en masse, fundamental shifts (and then reversions) of how leave entitlements are calculated, determining whether the evolving situation would be sufficient to implement unpaid stand downs, as well as a raft of cases questioning some of the basic concepts of employment, from what it means to be a casual, to what it means to be an employee itself!  And then in December, the Federal Government released its most substantive set of proposed changes to industrial relations legislation since the Fair Work Act commenced.

Tim Capelin | Partner

Tim is recognised as one of Australia’s leading workplace lawyers. He created and led Australia’s top boutique workplace law firm for more than a decade before accepting Piper Alderman’s invitation to join our practice.  Tim has over 25 years’ experience in employment and industrial relations law.

Tim understands the commercial realities of business from the perspective of a business owner and adviser. This background enhances Tim’s provision of strategic advice to clients on employment and workforce matters. He is an experienced advocate and has represented employers in all relevant tribunals and courts.

Tim’s industry knowledge includes working with clients in publishing, agribusiness, health, hospitality, finance, retail, logistics, resources, government, professional services, transport, building & construction, social & community services and pharmaceutical industries. He frequently presents on workplace law topics, is a regular contributor to industry and legal publications and is sought by the media for comment on workplace law issues.

Erin McCarthy | Partner

Erin has over fifteen years’ experience in providing advice to employers and employer associations on all aspects of occupational health and safety, employment and industrial relations law as well as delivering essential information seminars and training workshops on key employment issues.

Erin has extensive experience providing advice in relation to performance management, misconduct investigations and unfair dismissal claims, bullying, discrimination and harassment matters and occupational health and safety issues including risk management and policy development.

In particular, Erin has been involved in numerous enterprise bargaining processes for large organisations across industry sectors, supporting clients in the planning, negotiation and implementation stages of the process.

Erin is a co-author with Professor Andrew Stewart and Elise Jenkin of Parental Leave: A User-Friendly Guide, published by Thomson Reuters in December 2011.

As a part of our national team, Erin advises clients in all states and territories in Australia.

Prof Andrew Stewart | Consultant

 

Andrew is a leading expert in employment law, workplace relations and the general law of contract.

He consults exclusively to Piper Alderman in matters of legal practice while maintaining his position as the John Bray Professor of Law at the University of Adelaide. He has also undertaken consultancy work for Federal and State governments, the International Labour Organization, the Fair Work Ombudsman and other bodies, and was formerly the President of the Australian Labour Law Association.

His work for Piper Alderman clients includes presenting seminars on legal developments, and the preparation of advice on complex issues. He is particularly well known for his expertise and public commentary on the Fair Work legislation.

This expertise is further enhanced with the publication of several books, including being lead author of the popular texts Creighton & Stewart’s Labour Law, Stewart’s Guide to Employment Law and Intellectual Property in Australia. His most recent work, Contract Law: Principles and Context (co-written with Warren Swain and Karen Fairweather), was published by Cambridge University Press in 2019.

He is also the author of Independent Contractors: A Practical Guide, published by CCH in 2013 and Parental Leave: A User-Friendly Guide, published by Thomson Reuters in 2011. Both were co-written with other members of Piper Alderman’s Employment Relations team. Other recent books include Cooperation at Work: How Tribunals Can Help Transform Workplaces (with Mark Bray and Johanna Macneil) and a co-edited collection, The Wages Crisis in Australia.

Tim Lange | Partner

 

Tim is an employment relations lawyer with over 19 years’ specialist employment relations experience at top-tier and mid-tier firms.

Tim’s work focuses on achievement of commercial results with minimum disruption to the workplace through a combination of expert knowledge and a practical approach. He provides representation and advice on contentious and non-contentious matters.

Tim’s expertise encompasses a wide range of employment and industrial relations matters including the drafting and negotiation of enterprise agreements and awards, resolving industrial disputes, terminations and unfair dismissals, employment contracts and policies, issues around employee records and privacy, anti-discrimination, management of whistleblower disclosures, and work health and safety.

His diverse client base includes commercial organisations from a range of sectors including professional services, health, transport, retail, telecommunications and construction.

Tim has particular experience dealing with highly unionised workforces, as well as sensitive and strategic executive employment issues.

He is an experienced advocate, and brings a focus to negotiations and litigation that enables quick, efficient and appropriate resolution of disputes in Courts and industrial tribunals.
