As the COVID-19 vaccine becomes more available, many employers are considering incentive programs for their employees. This program will address key considerations for vaccine incentive programs.  Additionally, an uptick in governmental investigations is expected in 2021, and this program will summarize steps necessary to prepare for potential visits by the DOL and the EEOC.

Speakers

Josh C. Harrison - Shareholder

Josh represents and counsels businesses on employment law matters, including developing plans and strategies to tackle challenging circumstances, such as harassment investigations, workplace injuries or fatalities, business model challenges by independent contractors, and managing crises, such as the COVID-19 pandemic. In addition to daily advice and counsel, a significant portion of Josh’s practice includes defending clients against class and collective litigation or arbitration in multiple jurisdictions across the country. Many of these cases involve claims of independent contractor misclassification. Josh’s clients include companies with multi-state and international operations in a wide range of industries, including technology, construction, retail, distribution, higher education, manufacturing, and banking.

Josh has utilized his experience to build the Ogletree Deakins Model for Alabama Employers, a series of employment law compliance programs for growing and small businesses. These programs address employee handbooks and policies, wage and hour compliance, restrictive covenants (i.e., non-competition, non-solicitation, and confidentiality agreements), compliance plans for anticipated headcount and geographic growth, and independent contractor labor models. Josh delivers the programs on a flat-fee basis to ensure budgetary certainty and predictable pricing.

M. Tae Phillips - Shareholder

Tae focuses his practice on assisting clients with the many labor and employment challenges they face on a daily basis. He has been recognized by his peers by receiving an “AV Preeminent” rating by Martindale-Hubbell, and being selected as a “Rising Star” by Alabama and Mid-South Super Lawyers and the Birmingham Business Journal.

Aside from producing positive results, Tae maintains a client-centric approach to his practice and strives to provide exceptional and responsive client service. His primary goal in representing clients is to provide them with collaborative, efficient, and business-focused solutions to workplace disputes and issues.

A significant portion of Tae’s practice consists of employment litigation, and he regularly defends clients before federal and state courts and administrative agencies involving all types of employment claims. He also assists employers in traditional labor matters such as Union avoidance, election campaigns, collective bargaining, and labor arbitrations. He also advises clients on disputes involving non-compete and other restrictive covenant agreements.

Tae is heavily involved in the firm’s Drug Testing Practice Group, where he advises clients on all aspects of drug and alcohol testing. Tae is also a national expert on marijuana issues in the workplace, and regularly assists clients across the country in handling the rapidly-evolving laws involving medical and recreational marijuana.

Tae is an active member of the National Asian Pacific American Bar Association (NAPABA), and is proud to serve as co-chair of Ogletree’s Diversity and Business Resource Group for Asian American attorneys within the firm. He also serves as an officer within the Alabama Asian Pacific American Bar Association. Tae is also active within the American and Birmingham Bar Associations, and is a frequent speaker to groups across the country on a variety of labor and employment topics.

Prior to joining Ogletree, Tae practiced general civil litigation in Mobile, Alabama. He graduated cum laude from the University of Montevallo in 2006, and from the University of Alabama School of Law in 2009 where he served on the Alabama Law Review. Outside of work, Tae is a husband and father to two young children. He enjoys the Chicago Cubs, University of Alabama athletics, golf, and traveling.
