The work of the Electoral College is finished, the Georgia Senate runoffs have been decided, and the Biden-Harris Administration has begun. In this timely program scheduled for January 20, 2021, David Smith and Warren Lightfoot, Shareholders in Maynard Cooper’s Labor & Employment Practice Group, will focus on the universe of potential legal developments in L&E law that will occur in the earliest days of the new administration. The presentation will cover the existing laws and regulations that will be the center of change for the Biden White House and the constituencies that so strongly supported his candidacy. What can we expect in terms of reversing Trump’s executive orders, Biden’s appointments to lead federal agencies, the invigorated war on the pandemic, the federal minimum wage law and its amendment and enforcement, the expansion of the Unions’ rights to organize workers, and the enhanced enforcement of OSHA laws and regulations, to mention a few?

This program will raise our awareness of and help us prepare for the particular changes that will follow the platforms of the Biden campaign and the pace at which these agendas will influence the law in our country. All businesses with employees will be affected, and we encourage all of our members to participate in this program.


Speakers

David M. Smith - the founding member of Maynard Cooper's Labor & Employment Practice. He brings more than 30 years of experience as a labor and employment litigator representing business employers and their management. Recognition for David's work as an attorney includes his ranking by Chambers USA: America's Leading Lawyers for Business as a Leading Practitioner in Labor and Employment Law, a distinction he has earned every year since 2004. He is also a Fellow of the American College of Labor and Employment Lawyers. David's work includes cases alleging employment discrimination, breach of contract, wage and hour violations and mine safety violations, among many others. He has handled major cases against private plaintiff lawyers as well as the United States Department of Labor. This includes serving as lead trial counsel in one of the longest trials ever held under the Federal Mine Safety Law and in another marathon trial, serving as lead counsel in the then largest FLSA claim ever brought by the United States Department of Labor. Working on behalf and alongside his clients, David has successfully defended and tried to verdict numerous other jury and non-jury labor and employment cases. He has presented oral arguments in the Alabama Supreme Court and the United States Courts of Appeals for the Eleventh Circuit and the D.C. Circuit. In addition to his litigation practice, David advises clients on discipline, contracts, policies, arbitrations, RIF's and benefits in all types of employment and labor relations matters. He also educates clients and colleagues on numerous topics. He provides training to numerous clients' human resources personnel and workforces at large. David has also conducted employment law compliance audits for businesses all over the country.

Warren B. Lightfoot, Jr. - A member of Maynard Cooper's Labor and Employment Practice Group, Warren has more than 26 years of experience representing and advising clients in all aspects of labor and employment matters, including significant wage and hour and federal discrimination litigation. Warren's commercial litigation and business tort practice encompasses all aspects of non-compete enforcement, trade secret litigation, and competitive torts, as well as fraud, contract, and insurance disputes. He has successfully litigated, as lead counsel, dozens of such cases and, in his business tort practice, has obtained or defended companies against injunctions across the country. Highly respected by his peers, Warren served as Chairman of the Alabama State Bar Labor & Employment Section. His skills and accomplishments as a lawyer have earned him numerous accolades. He is distinguished as a Leading Practitioner in Labor & Employment by Chambers USA: America's Leading Lawyers for Business. He is a Fellow of the College of Labor and Employment Lawyers and consistently included in The Best Lawyers in America, as well as in MidSouth Super Lawyers in the area of Employment and Labor Law.
