ACC NortheastPlease join us for the first session of our three-part, in-depth look at conducting internal investigations. Attorneys from Ogletree Deakins, a leading national labor and employment firm representing employers, will lead a close-up review of best practices in conducting internal investigations. Each session will be unique so you can pick & choose the areas you in which you are most interested, or attend all three and have your investigation questions answered.
Topics to be covered in first session on June 8th will be:
Phase 1-Structure and Design:
- Can the investigation be privileged, and should it be?
- Who should conduct the investigation: Internal HR? External investigator? In-house counsel? Outside counsel?
- Pros/Cons and best practices
- Special issues arising from in-house counsel involvement: Upjohn warnings; Privilege challenges
- Remedial measures and handling employment of the accused
- Board involvement and dealing with accusations against/by senior leadership
- Scoping and special issues arising from scope challenges
- Document and ESI preservation/review
- Confidentiality
