While Las Vegas may be largely shut-down, work continues – mostly remotely – and the need to maintain confidentiality of privileged communications has never been greater.  This presentation will provide an overview of the attorney-client privilege, a brief survey of how courts apply the privilege to communications involving in-house counsel, and give the audience practical guidance to protecting privileged and confidential communications.  It will include hypotheticals and explore the impact of increased remote working arrangements on maintaining privileged communications. 


Speakers

Ted Holt is chair of the Insurance & Financial Services Litigation Practice Group. He litigates on behalf of insurance and financial services clients in a variety of disputes including sales practices, breach of contract and fiduciary duty, and bad faith claims handling in both individual and class actions. He has successfully defended clients in state and federal courts in more than a dozen states including litigation hot beds such as Alabama, California, Florida, Illinois, New York, and Texas.

In addition to Ted’s work on behalf of insurance and financial services companies, Ted is a member of the Energy & Natural Resources Practice Group. A significant portion of Ted’s energy litigation practice is devoted to coal bed methane litigation. He also works on behalf of energy clients in defending personal injury, fraud, contract, and commercial disputes. Beyond his litigation work, Ted advises clients regarding joint operating agreements, mineral leases, surface use agreements, and related operational agreements.

Ted is listed in Best Lawyers® for Litigation: Insurance and Martindale-Hubbell rates him as AV-Preeminent.

Ted received his J.D. cum laude from the University of Alabama School of Law, and he holds an M.B.A. from the University of Alabama at Birmingham and a B.A. from Rollins College.

 

Ashlee Riopka is an Associate at Maynard Cooper and focuses her practice on defending insurers, third-party administrators, plan administrators, plan sponsors, and employers in a variety of complex group insurance-related matters involving life, health, disability, and accidental death and dismemberment plans and coverages. Ashlee has extensive ERISA litigation experience and is well-versed in preemption, standard of review, scope of discovery, and ERISA remedy issues. Ashlee’s practice is also defending insurers in life and disability bad faith matters. She has defended health care and insurance clients in individual and class actions nationwide, and has significant experience coordinating and managing large-scale electronic discovery productions.

In addition to her law practice, Ashlee is a member of Maynard Cooper’s Women’s Initiative Committee in which she serves as co-chair of the Women’s Forum, and coordinates internal programming focused on the retention, development, and promotion of the Firm’s female lawyers.

Ashlee received her J.D. cum laude from the University Of Alabama School Of Law and holds a B.A. summa cum laude from Auburn University.

In recognition of her achievements, Ashlee earned Best Lawyer’s 2021 “Ones to Watch” recognition in Employee Benefits (ERISA) Law and Insurance Law.
