Given the growth of online services, as well as the need for providers of standardized goods and services to ensure uniformity in their legal terms, it is has become increasingly common for service and product providers to manage changes in their terms by providing unilateral updates and amendments to those terms via notice.  Such notices may be delivered electronically, by mail, through billing statements or other means.  This program will focus on the laws and court decisions related to such unilateral amendments.  This presentation will examine applicable statutes, common law contract principles as well as unfair and deceptive trade practice laws. There will also be a discussion of best practices that companies should consider adopting to improve the enforceability of their unilateral contract update and amendment practices.
