Thankfully, we’re in the home stretch of 2020, a year which has given us a fair share of important entertainment cases in addition to everything else we’ve been dealing with.  In this panel, attorneys from Greenberg Glusker will discuss the impact of some of the year’s most important decisions, including such topics as:

  • Copyright in historical facts, including “fictionalized” facts – Corbello v. Valli (“Jersey Boys” case);
  • The Ninth Circuit’s approach to early dismissal in substantial similarity cases (“The Shape of Water,” “Pirates of the Caribbean,” “Empire” and “Inside Out”)
  • The use of IP in expressive works or commercial products – including cases involving Activision/Humvee and Jack Daniels

Speakers

Aaron J. Moss is the Chair of Greenberg Glusker's Litigation Department, and specializes in intellectual property and entertainment litigation matters. He has handled high profile copyright and trademark actions for both plaintiffs and defendants, including studios, production companies, video game publishers, toy and consumer products companies, apparel manufacturers, technology firms and individuals. Aaron is the immediate past president of the Los Angeles Copyright Society, and regularly writes about copyright issues for his blog Copyright Lately.

Priya Sopori is a litigation partner and Co-Chair of Greenberg Glusker’s Cannabis Group. As an award-winning former federal prosecutor and partner in private practice, she is undefeated at trial and arbitration. She utilizes her legal savvy and vast courtroom experience to provide clients with the skilled representation and counsel they need during high-stakes litigation and crisis situations. Her most recent complete defense trial victories include multimillion-dollar claims of employment discrimination, wrongful termination and defamation. While she has prevailed on summary judgment for a wide array of companies, she has also successfully persuaded litigants to drop their claims against high-profile clients and the companies to which they lend their names and reputations. She currently provides counsel to a number of high net worth individuals, private schools, and cannabis companies and was recently named one of 24 Cannabis Law Trailblazers by The National Law Journal. In addition to traditional business matters, her extensive experience includes intellectual property, copyright and trade-secret protection, extortion and cybercrime, licensing agreements for music and internet/television rights, international film financing and distribution, securities litigation, sexual harassment claims, entertainment litigation and white-collar investigations. She is the former outside General Counsel to The Groundlings Theatre and Improv School and is currently the President of Women in Media. She is involved with a number of other Advisory Boards, including Diavolo Dance Theatre, British-American Project, and the South Asian Bar Association. 

Josh Geller is a litigation attorney and Co-Chair of Greenberg Glusker's Coronavirus Task Force. His practice focuses primarily on entertainment and intellectual property litigation. Josh has significant experience representing studios, production companies, video game publishers, musicians, graphic artists, and other independent content creators. He assists clients in navigating all stages of the litigation and dispute resolution process, including pre-litigation counseling, trial, and alternative dispute resolution. He also has significant appellate experience, litigating before both the California Supreme Court and the Ninth Circuit.
