Competition/antritrust law matters can involve some of the largest mergers or investigations by the government, but they also bear upon on day to day strategies that companies engage in to outduel their competitors. Increasingly, competitors and vendors in wide ranging industries (including smaller ones) are claiming that unfair strategies are foreclosing their ability to penetrate a given market. Some of these strategies, such as raising barriers to entry and expansion, are promoted in business schools and literature, but carry antitrust risk, with claimed damages often in the hundreds of millions (as antitrust damages are automatically triple by statute). Join Marsh and McLennan Companies Chief Competition Counsel Misha Vanyo and antitrust litigator and counselor David Reichenberg for an entertaining and informative session on how to identify and mitigate against these potentially problematic scenarios.
