Privilege & Communications Best Practices for In-House Lawyers

Identifying privilege for business communications is complex.  In-house lawyers often face the following challenges:

  1. Which internal emails are covered by solicitor-client privilege?  What are the best practices to help bolster claims of privilege for internal emails?

  2. What is the effect of marking letters “without prejudice”?

  3. How to manage privilege and internal investigations

Panelists Charlotte Feasby, Senior Counsel at Syncrude Canada Ltd, Laurie Goldbach, Partner at BLG; and Clay Jacobson, Partner at BLG will discuss the above questions, give an update on current issues relating to privilege and give a practical overview of the varieties of privilege for in-house teams including how best to utilize:

o   Common interest privilege

o   Settlement privilege
