What Regulators Expect: Implementing Effective Compliance Programs to Mitigate Enforcement Risks You need only look at recent headlines to see that compliance issues continue to present a major risk to corporate America. In a recent survey conducted by the Association of Corporate Counsel, 74% of Chief Legal Officers reported that the number-one issue keeping them up at night is compliance and ethics, with 28% reporting that a regulator targeted their company last year for an enforcement action. And though the pace of enforcement under the new administration may have slowed, the penalties continue to rise – with the Department of Justice and Securities and Exchange Commission regularly reaching settlements in the tens of millions of dollars, and more. We invite you to join us for a unique opportunity to hear from some uniquely qualified professionals about what prosecutors and staff at the DOJ and SEC focus on when deciding to litigate matters and what companies can do to both mitigate and defend against these issues. Jessica Matelis has recently joined Foley & Lardner after nearly five years at the U.S. Securities and Exchange Commission where, as a Senior Counsel, she investigated and litigated various matters related to risk controls and procedures for public companies and investment advisers. She also played a critical role in the development and implementation of data analytics software for the Enforcement Division. Foley partner Rohan Virginkar spent more than six years as a trial attorney at the U.S. Department of Justice's Criminal Division, Fraud Section, where he investigated and prosecuted foreign bribery cases as a member of DOJ's FCPA Unit. He also served as a member of DOJ's Deepwater Horizon Task Force, which investigated and prosecuted environmental, securities, and other crimes arising out of the 2010 oil spill in the Gulf of Mexico.
