The panel discussion will focus on practical implications for both transactional attorneys and litigators to consider when drafting contracts and handling commercial contract disputes. The panel will address consequences and the enforceability of clauses such as forum selection, choice of law, arbitration, non-reliance, fee-shifting, damages limitations, and time limitations.


Speakers

Laura A. Brake, Senior Counsel, Litigation, AbbVie. Laura's practice includes litigation, investigations, and contract review relating to dispute resolution issues. Prior to AbbVie, Laura worked as a litigation attorney at Katten Muchin Rosenman LLP.

Gretchen D. Kaplan, Associate General Counsel, Brookfield Properties (formerly GGP). Gretchen handles and regularly advises her business counterparts in the Litigation and Employment Group, on a wide variety of contractual, commercial, employment, accounting, and policy matters. Before going in-house, Gretchen worked in private practice, most recently at Shook Hardy & Bacon in Chicago, as well as at Willkie Farr & Gallagher in New York.

Amy Y. Cho, Partner, Shook, Hardy & Bacon. Amy has tried matters to verdict through trial and arbitration. She has represented both defendants and plaintiffs in cases involving breach of contract, breach of fiduciary duty, fraud, insurance coverage, and employment issues. Riley C. Mendoza, Shook, Hardy & Bacon. Riley has significant experience in all phases of litigation through appeal and has tried matters to verdict at trial. Matthew C. Wolfe, Shook, Hardy & Bacon. Matt has experience in commercial litigation, class actions, and insurance coverage disputes, representing both plaintiffs and defendants.
