The Uyghur Forced Labor Prevention Act (UFLPA) went into effect on June 21, 2022, and companies have been grappling with how to quickly implement new practices and procedures to ensure their imported goods comply with the new legislation and are allowed entry into the U.S. Both U.S. Customs and Border Protection (CBP) and Department of Homeland Security issued guidance documents in June to assist importers in understanding some of the types of information that the government will require if an importer argues that its goods were not made with forced labor. CBP has been actively detaining goods under the UFLPA and, to date, importers have largely been unable to provide CBP with sufficient information to obtain release of their goods.
This webinar will discuss:
• The current enforcement status of the UFLPA, and the employment of tools recommended by CBP to demonstrate that no forced labor exists in the sourcing of a good, such as supply chain mapping and the development of a forced labor compliance program.
• Best practices for companies seeking to navigate the forced labor laws not only in the U.S., but also in China that implemented the Anti-Foreign Sanctions Law in 2022.
• What is on the horizon for companies in Europe in the forced labor area, both at the national and EU-wide levels.

The “war” exclusion in cyber insurance policies has received increased attention over the past several months, particularly in light of Russia’s invasion of Ukraine. It is unclear how the common form of the exclusion should operate in cyber insurance policies. Those policies are intended to cover cyber-attacks. From a policyholder’s standpoint, who originated the attack and their motivations should be irrelevant. In fact, it is often never established who perpetrated an attack and why. But the war exclusion seems to call for an almost impossible exercise of attribution and speculation about motives, and its language is opaque. The London insurance market recently proposed alternative versions of the exclusion, and insurers are considering their own revisions. We expect there to be significant changes in some markets in the next year or so. Join us in-person as we discuss the issues this state of flux raises for policyholders.
