Update on the CCPA and Now, Virginia, Too!

Virginia recently became the second state to pass a comprehensive and far-reaching privacy law, the Consumer Data Protection Act. The law, with heavy influence from the EU’s GDPR, is on par with the California Consumer Privacy Act, which recently saw its own updates. Join us as we explain what these changes mean for organizations across the country, provide tips on complying with these laws, and discuss the future of privacy laws in the US.

What You Will Learn

In a traditional software licensing or hardware purchase engagement, the service provider installs the software or equipment in the customer’s environment.  Cloud computing involves accessing a provider’s software and infrastructure remotely and often includes storing the customer’s data with that provider.  Learn why these structural differences mean you need to think differently about how to license, what business risks to prioritize and address in your license agreements, and what contractual remedies you need to ensure business continuity and protection against liability.

This program will provide content to enable experienced attorneys to develop and maintain legal skills related to the negotiation and drafting of contracts in the practice areas of technology transactions and cloud licensing. The program will provide attorneys with an understanding of general structural differences between various cloud computing structures to improve practice management and better counsel and advise on appropriate strategies. Specifically, discussion will involve practice pointers to assist with problem solving, legal analysis and reasoning, drafting of transactional documents, and counseling clients related to license grants, termination rights, and common risks and remedies.

Why You Should Attend

  • Gain an understanding of various cloud computing structures, including newer ones such as edge computing
  • Learn how to develop and implement a cloud licensing strategy
  • Address loss of control with creative remedies and risk mitigation strategies in your contracts

Who Should Attend

The audience level will be intermediate – IP experience, but not all will have negotiated software licenses or cloud-based agreements.

Digital transformation, the process of leveraging technology, people and processes to innovate, requires an “all-in, ongoing commitment to improvement.” Often, however, digital transformation requires organizations to give vendors access to their electronic systems and sensitive information, including personal information. This can lead to disastrous consequences as was the case last year for thousands of non-profit organizations whose information was compromised when Blackbaud, their data management solutions provider, experienced a ransomware attack that exposed customer data. On March 18 please join us for a discussion about the new laws and industry standards that have emerged to safeguard information in these contexts.

It’s clear that an organization benefits when its top leaders include both men and women. What is the role of men in gender equity work? Join us for this informative presentation by Dr. Madsen, followed by breakout sessions with our panelists to discuss allyship and strategies to create an organizational culture that encourages the advancement of all.

This seminar is open to all ACC members as well as other leaders in your organizations.

In this one-hour long webinar, attorneys from Holland & Hart and guest speaker Greg Clouser from Empower Retirement will discuss:

Roundtable - Complying with New Colorado Employment Law – Lessons Learned

  • What are we seeing with the new laws lessons we are learning and what you should know.

Covid-19 has caused a wave of massive disruptions to international trade, investment flows, and international travel. These disruptions strengthened both globalization and anti-globalization forces as well as accelerated many pre-pandemic global trends, such as economic growth patterns, supply chains, and geopolitical frictions.
Join us for a virtual discussion with Miles Hansen, World Trade Center Utah president and CEO and former White House national security official, on the short and long term effects of Covid-19 on international business.

Join ACC National Capital Region for a webcast on - What Comes after Privacy Shield: Negotiating Cross-Border Data Transfers with Your Vendors and Service Providers

What began over two years ago mainly as a “battle of the forms” to update terms of Data Protection Agreements for GDPR has now exploded into a complex discussion of how to address European personal data transfers in light of the Schrems II decision. With Privacy Shield now being invalidated and the EU Standard Contractual Clauses being called into question, companies now have an uncertain path forward for transferring personal data from Europe to the United States. We will explore potential strategies, what happens with Privacy Shield, and whether amendment of current mechanisms are needed in order to limit GDPR risk. In light of the uncertainty, we will discuss how such cross-border transfers can be approached.

Now more than six months into the pandemic, a surge of Covid-19-sparked litigation is no longer speculation, but a reality.  Through mid-October, Shook has tracked nearly 4,000 lawsuit filings. This program will include a presentation of the litigation by one of Shook’s leading attorneys in civil justice reform which will explore the most common claims, the industries or types of businesses most frequently targeted, and the first rulings in Covid-19 related cases. The program will also highlight the response by legislatures across the country, which are working to enact Covid-19 liability protections, and the remaining threats to businesses now and in the months to come.  While the legislative response is making inroads to protect businesses, plaintiffs’ lawyers have plenty of room to wreak havoc in an already fragile business environment.  Plan to join in on the roundtable discussion as the panel discusses those threats and what in-house counsel can do to help mitigate those risks.  Bring your questions so this experienced panel can address those topics of greatest concern to you and your company.

This program’s speaker panel includes:  Cary Silverman, Partner (DC) with Shook’s Public Policy Practice, Amy Attwood, Attwood Public Affairs, a lobbyist for the Colorado Civil Justice League (Denver), and Michael Mallow, Partner (Los Angeles) with Shook’s Class Action Practice. Paul Williams, Partner (Denver) with Shook’s General Liability Litigation practice will host the speaker panel.
