In this session, Littler Shareholders Ethan Thomas (Las Vegas) and Michelle Gomez (Denver) will guide you through addressing return to work and work-from-home battles, performance issues commingled with protected leaves or accommodations, leave obligations beyond FMLA, organizational changes and the impact of the FMLA/ADA on those changes. They will also touch on the additional hot topic of lawsuits over access to companies’ websites and physical locations. Finally, they will address how the isolation, stress and suffering of the COVID-19 pandemic has significantly affected employees’ mental health.  Employers need to recognize these behaviors and know the immediate and long-term options available to address them in order to protect workplaces from conduct that could lead to dangerous workplace conditions.

Participating in pro bono work can pose unique challenges for in-house attorneys. These include a lack of employer-provided professional liability coverage, lining up your skillset with available pro bono work, or simply finding the time to connect with and participate in pro bono opportunities. Fortunately, the Idaho Supreme Court Pro Bono Commission and the Idaho Volunteer Lawyers Program can help alleviate some of these challenges.

Idaho Supreme Court Justice and Idaho Pro Bono Commission Chair Robyn Brodie will lead a discussion on Idaho Rule of Professional Conduct 6.1 (Voluntary Pro Bono), the Idaho Pro Bono Commission’s mission, and making time for pro bono work. IVLP Director Jennifer Schindele will also be on hand to discuss many of the pro bono opportunities available to in-house counsel in Idaho. And finally, Maggie Thompson, CASA Advocate Supervisor with Family Advocates, will discuss how in-house attorneys can serve as guardian ad litem counsel in child protective action cases in Idaho’s Fourth District.

A Trusted Advisor/Leader to the Executive Team and
Respected Counsel to the Board of Directors

Reception begins at 5:30 p.m.
Dinner at 6:00 p.m.

The value of your role as an internal legal advisor is evolving right alongside the operation cadence of your organization.  In-house lawyers are key members of the corporate decision-making team. Some corporate counsel already participate in strategic meetings and provide wide-ranging counsel as decisions are being made.

How will you elevate your status and serve as a trusted advisor and member of your organization’s executive team? When will you make the leadership leap to where you become respected counsel to the board of directors? Join the ACC for this unique opportunity to gain firsthand insight from leading Colorado CLOs about personal experiences in the evolution of their organizational roles.

The ACC Emerging Leaders Group is proud to provide all ACC members with this opportunity to sit down with four of Colorado’s prominent CLOs who will share their experiences in a casual, conversational setting.

Hear from the following featured guests:

  • Robin Ricketts, VP and General Counsel, Lockheed Martin Space
  • Sherin Sakr, General Counsel, WellBiz Brands

Noncompete, Nondisclosure or Misdemeanor?
The New Penalty Under C.R.S. 8-2-113 and Emerging Data Privacy Challenges

Program Overview:

4-4:30 PM - Registration/Networking
4:30-5:30 PM - CLE

5:30-6:30 PM - Reception

This presentation will explore the implications of the recent change to C.R.S. § 8-2-113, which makes violation of the statute restricting non-competition agreements a class 2 misdemeanor.  We will provide practical tips and takeaways and review the current state of Colorado case law as well as dos and don'ts in crafting acceptable non-competes under the statutory requirements.

At the same time, certain restrictive covenants are becoming less and less optional.

New data privacy laws require that employees exposed to confidential customer data sign nondisclosure agreements.  These agreements, however, may also implicate C.R.S. § 8-3-113.  Business handling protected customer data will have to navigate their obligations under C.R.S. § 8-2-113 while also enforcing acceptable nondisclosure agreements under emerging data privacy laws, including the Colorado Privacy Act.

Speakers:

William Groh, Senior Associate, Robinson & Henry, P.C.

Jenifer McIntosh, Prodigy, In-House Counsel Attorney
